MSR.jp 6/13/79 <br />ORIGINALR E S O L U T I O N N o. 8297 JUN 181979 <br />RESOLUTION APPROVING AND AUTHORIZING EXECUTION OF <br />REVOCABLE ENCROACHMENT PERMIT RELATING TO CONSTRUC- <br />TION OF WOODEN PATIO DECK ON A PORTION OF STORM <br />DRAINAGE EASEMENT IN THE VICINITY OF 407 OAK AVENUE <br />WHEREAS, Oak View Company, as owner of real property, <br />commonly known as 407 Oak Avenue, has requested permission to <br />construct a wooden patio deck on a portion of a storm drainage <br />easement located on the aforesaid real property, which easement <br />is more particularly described as follows: <br />and <br />"That grant of easement to the City of Redwood City, <br />dated April 7, 1967, from Paul Vittori and Mafalda Vittori, <br />his wife, and Arcede Vittori, an unmarried man, recorded <br />in the Office of the Recorder of San Mateo County, <br />California, in Volume 5306 at pages 117, 118 and 119, <br />on May 12, 1967."; <br />WHEREAS, it is the intention and desire of this Council to <br />grant a revocable encroachment permit permitting such use, subject <br />to certain terms and conditions; <br />NOW, THEREFORE; <br />BE IT RESOLVED BY THE COUNCIL OF THE CITY OF REDWOOD CITY, <br />AS FOLLOWS: <br />1. That the City Manager is hereby authorized to execute <br />and cause to be recorded a revocable encroachment permit to <br />Oak View Company to construct a wooden patio deck on a portion <br />of a storm drainage easement more particularly described in <br />that Grant of Revocable Encroachment Permit (form dated 6/13/79) <br />which is attached hereto and by this reference incorporated <br />herein. Said revocable encroachment permit shall not be <br />effective until such time as Oak View Company executes an <br />acceptance of its terms and conditions, and pays to the City <br />of Redwood City any fees required therein. <br />2. That the permit granted shall be in the form of the <br />aforementioned Grant of Revocable Encroachment Permit. <br />8297 <br />
