F. - Page 40 WHEREAS, the State, acting by and through the Executive Officer of the Commission pursuant to Staff Report No. , has accepted the quitclaim from the City of the Trust Termination Lands; and WHEREAS, the Commission has found and declared, inter alia, that the sovereign interests within the Trust Termination Lands have been filled and reclaimed and cut off from access to the waters of the San Francisco Bay, are no longer in fact tide or submerged lands, and are relatively useless for purposes of the public trust for commerce, navigation, and fisheries (public trust); and WHEREAS, pursuant to the Agreement, it is the intent of the State to convey to the City all of its right, title, and interest in and to the Trust Termination Lands, to be accepted and held by the City free of the public trust and the terms and conditions of the Granting Act (statutory trust), for the purpose of effectuating the exchange contemplated in the Agreement; and NOW, THEREFORE, The STATE OF CALIFORNIA, acting by and through the STATE LANDS COMMISSION, does hereby REMISE, RELEASE, AND FOREVER QUITCLAIM to the CITY OF REDWOOD CITY all of its right, title, and interest in the Trust Termination Lands. This Patent is intended to and does terminate the public trust and the statutory trust in the Trust Termination Lands, and the Trust Termination Lands are hereby forever freed from the public trust and statutory trust.
