6.1.F. - Page 64 <br />C. The City agrees that the License does not relieve it of any Lease obligation <br />or alter any Lease provisions, terms, covenants, or conditions. <br />2. Bair Island Aquatic Center, Inc. <br />a. BIAC ratifies the License and affirms its continued effectiveness despite <br />conveyances of the License Parcel. <br />b. As to the Trust Parcel, BIAC agrees that the License is subject to all the <br />provisions, terms, covenants, and conditions of the Lease; notwithstanding, BIAC shall maintain <br />insurance and indemnify the City as required by the License. <br />C. BIAC acknowledges that it has read and understood the Lease and agrees <br />to perform all its provisions, terms, covenants, and conditions. BIAC agrees that, in event of its <br />breach of the Lease, the Commission may exercise remedies directly against BIAC. <br />3. California State Lands Commission. <br />a. The Commission consents to the License and affirms its effectiveness <br />between the City and BIAC as to the Trust Parcel, subject to the provisions, terms, covenants, and <br />conditions of the Lease. <br />4. Effective Date of Agreement. This Agreement shall be effective as of the date of <br />the Lease regardless of when signed. <br />5. Duration of this Agreement. This Agreement shall end upon termination of the <br />License or the Lease, whichever is earlier. <br />6. Counterparts.
