6.1.H. - Page 2 <br />Number 2 to the agreement were executed on May 11, 2004 and November 10, 2004 <br />respectively. <br />On December 7, 2007, the City executed a similar agreement for a five-year duration <br />with the Service for predator management service, which expired in December 2012. <br />On March 25, 2013, the City executed a similar agreement for a five-year duration with <br />the Service for predator management service that is now expired. <br />The current Cooperative Service Agreement, which is the subject for consideration and <br />approval by Council, will extend the PMP for another five-year duration. Once executed, <br />the CSA can be terminated with a 60 -day written notice by either party. The termination <br />will depend largely upon the status of the federally listed species. <br />Article 3 of the CSA contemplates an annual Work and Financial Plan (WFP) between <br />the City and the Service for predator management, which will be incorporated into the <br />Cooperative Service Agreement. For the first year, the WFP will be implemented <br />between April 1, 2018 and March 30, 2019. The first year budget is $57,600. The <br />budget can vary from year to year, but the amount and the scope will be submitted with <br />the annual WFP for the City to approve. <br />Over the five-year duration of the Cooperative Service Agreement, the total expenditure <br />will exceed the City Manager's spending authority of $60,000. Staff recommendation is <br />for Council to approve and authorize the City Manager to execute the first year's Work <br />and Financial Plan and to authorize the City Manager to execute future WFPs over the <br />remaining years of the agreement in conformance with the Cooperative Service <br />Agreement. <br />ALTERNATIVES <br />The City Council may choose not to authorize the execution of the Agreement; however, <br />this will result in violation of the requirements set forth by the Federal Permit. <br />FISCAL IMPACT <br />Funds are available in the Capital Projects Fund — Levee Predator Regulatory <br />Management account that has an available balance of $51,000.00 and Capital Projects <br />Fund — Levee Compliance account that has an available balance of $42,751.42 as of <br />May 11, 2018. <br />ENVIRONMENTAL REVIEW <br />
