6.1.F. - Page 2 <br />Aqreement (DDA) between the City and MidPen Housing. The DDA describes the <br />terms and conditions that will govern the conveyance of the property and the <br />development of the project. The DDA includes the development terms and defines <br />obligations and responsibilities of MidPen Housing and the City and outlines key <br />elements including the project description and project attributes, design and <br />environmental review process, financing plan, development schedule, incorporation of a <br />childcare center, and development of the Creekside Trail, among other DDA elements. <br />On December 5, 2017, the Planning Commission approved a Downtown Planned <br />Community Permit with seven Guideline deviations, a Vesting Tentative Parcel Map, <br />and a density bonus parking concession for the Project. No appeal of the Planning <br />Commission's decision was filed. The decision became effective on December 21, <br />2017. <br />Backqround on Need for Property Exchanqe <br />The City is the owner of the real property consisting of three contiguous parcels located <br />on Bradford Street between Main Street and Jefferson Avenue within the boundaries of <br />the City's Downtown Precise Plan, known as San Mateo County Assessor's Parcel Nos. <br />052-372-200, 052-372-170 and 052-372-240. A majority of this site temporarily is being <br />used as a surface, automobile parking lot. <br />During the development and title review process, City staff identified that a portion of the <br />property was conveyed to the City in trust by the State of California (State Lands <br />Commission) in the 1940s. The granting statute that conveyed this land to the City has <br />certain restrictions on it. Most notably, it allows for certain uses on this land, and <br />residential use is not an allowed use. The portion of the property that was granted to the <br />City was the historical location of Redwood Creek. In the 1960s, Redwood Creek was <br />rerouted, and the original location of Redwood Creek was filled. However, the granted <br />lands map were not updated at that time. Therefore, the conflict remains, and the land <br />must be exchanged "out of the trust" with another Redwood City based property. As <br />described below, the property that is being proposed to come into the trust is a portion <br />of the City owned property on Maple Streets located within and adjacent to Steinberger <br />Slough. Additional details about both properties, as well as the State Lands Commission <br />exchange process, can be found in the Analysis section below. <br />ANALYSIS <br />In order to allow the affordable housing development project at 707-777 Bradford Street <br />to proceed, the City must complete a land exchange agreement with the California State <br />Lands Commission. <br />
