The parties to the Agreement are the STATE OF CALIFORNIA, acting by and through <br />the STATE LANDS COMMISSION (Commission), and the CITY OF REDWOOD CITY, a <br />municipal corporation (City). The Commission and City are referred to together as the <br />"Parties." This Agreement is entered into pursuant to Public Resources Code section 6307. <br />RECITALS <br />A. This Agreement concerns a 0.84 -acre portion of the tract of land situated within <br />the City commonly known as 707-777 Bradford Street, including lands adjacent to and within <br />Redwood Creek (Bradford Street Site), together with approximately 6.09 acres of land situated <br />within the City commonly known as 1402 Maple Street, including land adjacent to and within <br />Steinberger Creek (Maple Street Site). The Bradford Street Site and Maple Street Site are <br />shown for illustrative purposes on Exhibit A. <br />B. Upon its admission to the Union on September 9, 1850, the State of California <br />(State), by virtue of its sovereignty, received all right, title, and interest in tide and submerged <br />lands (collectively tidelands) within its boundaries up to the ordinary high-water mark, subject <br />to the public trust for commerce, navigation, and fisheries (Public Trust). <br />C. Beginning in 1945 the State enacted a series of statutes, including, without <br />limitation, Chapter 1359 of the Statutes of 1945, Chapter 1394 of the Statutes of 1947, Chapter <br />34 of the Statutes of 1954 (1st Ex. Sess.), Chapter 2125 of the Statutes of 1961, and Chapter <br />1658 of the Statutes of 1963 (collectively, as amended, Granting Statutes), granting to City all <br />
