As a result of the construction of levees for salt <br />production to the east of the creek, the placement of fill and construction of docks along both <br />Redwood Creek and Steinberger Creek, and other artificial activities occurring over the last <br />century, the last natural location of tidelands within the creek cannot be determined with <br />precision. Historic maps suggest that smaller sloughs penetrated the adjacent uplands at various <br />times but have since been filled and cut off from the water. <br />G. A portion of the filled lands within the Bradford Street Site, as a result of their <br />reclamation, have been cut off from Redwood Creek and their utility for trust purposes has <br />substantially diminished. The lands have been used primarily for surface parking since <br />In addition, there are presently no public access improvements to the portion of Redwood Creek <br />within the Bradford Street Site, and the entire site is enclosed with a chain link fence. <br />H. As part of the Bradford Street Project, the City proposes to remove from the <br />Trust that portion of the filled tidelands within the Bradford Street Site that are no longer useful <br />for Trust purposes, and to build a 7 -story affordable housing development on those lands and the <br />adjacent Rancho Parcel. The new building will include 117 units of senior housing at the very <br />low income affordability level and an 8,000 square foot child care facility. The City also <br />proposes the construction of public access and park improvements along the western bank of <br />Redwood Creek and adjacent lands, including a portion that may be historic uplands. The <br />improvements will include a public creekside trail with access from Bradford Street and from <br />Main Street, opening this segment of the creek to the public for the first time in years. <br />Implementation of the Project, including the open space improvements, is not possible without <br />this Agreement. <br />I. Steinberger Creek is presently navigable and useful for Trust purposes, including <br />recreation and fishing. The uplands and filled lands within the Maple Street Site immediately <br />adjacent to the shoreline of the creek are also useful to the Trust. The City's planning documents <br />designate the Maple Street Site as a future public park and the location of a segment of the Bay <br />Trail. The Redwood City General Plan identifies the area between Redwood Creek and Bayfront <br />Park, including the Maple Street Site, as a major local gap in the Bay Trail. A portion of this gap <br />runs along Steinberger Creek through the Maple Street Site. The remainder of the Maple Street <br />Site consists of historic uplands or minor sloughs that have been filled and reclaimed and cut off <br />from the water. These lands, which are zoned for industrial uses and are currently used for <br />construction staging, parking, and storage, are not useful for Trust purposes. <br />J. As a result of the boundary and title uncertainties affecting the Maple Street Site, <br />it is possible that portions of Steinberger Creek are not presently subject to the Public Trust, the <br />Granting Act Trust, or both. In addition, substantial portions of the shoreline that are useful to <br />the Trust may not be presently subject to the Trust. At the same time, the filled sloughs in the <br />upland portions of the Maple Street Site may be subject to the Public Trust or a Public Trust <br />Easement, but are not useful to the Trust. <br />K. Public Resources Code section 6307 provides that the Commission may enter into <br />an exchange, with any private or public entity, of filled or reclaimed tide and submerged lands <br />that are subject to the Public Trust, for other lands or interests in lands, if the exchange is made <br />for certain purposes, including: to enhance the physical configuration of trust land ownership; to <br />enhance public access to or along the water; to enhance waterfront and nearshore development or <br />3 <br />
