06/11/2018 <br />impede the normal development of surrounding property as the project is <br />located on land that is already improved with buildings and will not obstruct <br />access or future development of adjacent parcels; <br />e. Adequate public and private facilities such as utilities, landscaping, parking <br />spaces and traffic circulation measures are or will be provided for the <br />proposed use. <br />Section 5. Planned Communitv Permit (DPC2014-09): In the exercise of its <br />independent judgment, the Council finds that: <br />a. The project and improvements proposed under Downtown Planned <br />Community Permit Application No. DPC2014-09 are consistent with, conform <br />to the intent of, and will appropriately implement the Downtown Precise Plan <br />for the 851 Main Street project; <br />b. The establishment, maintenance and operation of the project and <br />improvements proposed under Downtown Planned Community Permit No. <br />DPC2014-09 will not, under the circumstances of this particular case, be <br />detrimental to the health, safety, peace, morals, or general welfare of persons <br />residing or working in the neighborhood of the project, or be detrimental or <br />injurious to property or improvements in the neighborhood of the project, or to <br />the general welfare of the City, because the project has been found to be <br />consistent with the community goals established in the City's General Plan <br />and Zoning Ordinance; <br />c. The Project and improvements comply fully with all applicable standards of <br />the DTPP, as amended to increase the office development cap, with the <br />exception of Historic Preservation Standard 2.1.3.DD.1.d for height of <br />additions to the historic landmark located at 847-849 Main Street; <br />Cl. The Project and improvements comply fully with all provisions of the <br />Exceptions to the Historic Resource Preservation Standards process as <br />detailed in DTPP Section 2.0.3.A.3.a for Historic Projects; <br />e. The Project and improvements proposed under Downtown Planned <br />Community Permit Application No. DPC2014-09 will not create a significant <br />adverse impact on the historic landmark located at 847-849 Main Street, nor <br />the historic landmark located adjacent to the project site located at 837 Main <br />Street (IOOF Building; DTPP Historic Resource CC); nor the Main Street <br />Historic District, and all resources including the District will retain their <br />eligibility for listing on the California Register of Historic Places as detailed in <br />HRAC Resolution No. 17-02 and the 851 Main Street Historic Preservation <br />Analysis; <br />f. The Project and improvements comply with all but ten guidelines of the DTPP <br />pertaining to maximum establishment length, building base and middle <br />fagade composition, general private frontages, fagade height articulation, and <br />parking space and access lane design. The project, including the ten <br />requested guideline deviations, would appropriately implement the goals, <br />vision and intent of the DTPP. <br />Section 6. Proiect Recommendation Subiect to Conditions of ADDroval: The <br />Council approves the Project, based on certification of the SEIR and adoption of the MMRP, <br />ATTY/RESO.0051/CC RESO APPROVING THE DOWNTOWN PLANNED COMMUNITY PERMIT -851 MAIN ST PROJECT <br />RESO NO. 15676 <br />REV: 05-31-18 PR MUFF NO. 601 <br />Page 5 of 6 <br />
