38 Applicable Law <br />39 "Applicable Law" means all federal, State, and local laws, regulations, ordinances, rules, orders, <br />40 judgments, decrees, permits, approvals, or other requirements of any governmental agency <br />41 having jurisdiction over the Collection, transportation, Processing, and Disposal of Solid Waste, <br />42 Targeted Recyclable Materials, Organic Materials and other materials Collected pursuant to this <br />43 Agreement that are in force on January 1, 2011 and as they may be enacted, issued, or <br />44 amended during the Term. <br />45 Application <br />46 "Application" means the application prepared and submitted by Contractor for determination of <br />47 Contractor's Compensation for the following Rate Year. <br />48 Authority <br />49 "Authority" means the South Bayside Waste Management Authority or "SBW MA." <br />50 Average Hold Time <br />51 "Average Hold Time" means the sum of all call Hold Times divided by the number of calls <br />52 answered by the agent or queue of agents over the same time interval. <br />53 Average Speed of Answer <br />54 "Average Speed of Answer" means the sum of time Customers wait for their calls to be <br />55 answered after the call is queued (upon completion of the introductory voicemail message(s) or <br />56 Customer bypassing the message(s)) divided by the total number of calls received over the <br />57 same time interval. <br />58 Backyard Collection Service <br />59 "Backyard Collection Service" means the provision of Collection Service to a SFD in the rear or <br />60 side Premises. <br />61 Billings <br />62 "Billings" or "Bills" means statements of charges for services rendered by Contractor, to Owners <br />63 or Occupants of property, including Residential and Commercial Premises, for the Collection of <br />64 Solid Waste, Targeted Recyclable Materials, Organic Materials, and other materials Collected <br />65 pursuant to this Agreement. <br />66 Bin <br />67 "Bin" means a metal Container with capacity of approximately one (1) to eight (8) cubic yards, <br />68 with a hinged lid, with or without wheels, typically serviced by a front -loading Collection vehicle. <br />69 Bulky Items <br />70 "Bulky Items" means large items including, but not limited to, Major Appliances, furniture, tires <br />71 (with rims removed), carpets, mattresses, and other oversize materials whose large size <br />72 precludes or complicates their handling by normal Collection.
