77 Business Days <br />78 "Business Days" means days (i.e., Monday through Friday) during which Contractor's office is <br />79 open to do business with the public. <br />80 Cart <br />81 "Cart" means a plastic Container with a hinged lid and two wheels that is serviced by an <br />82 automated or semi -automated Collection vehicle. A Cart has capacity of 20, 30, 60, or 90 <br />83 gallons (or similar volumes specified in Attachment D). <br />84 Cell Phones <br />85 "Cell Phones" means all telephones used for mobile or cellular communications including <br />86 batteries used to power cell phones. <br />87 Change in Law <br />88 "Change in Law" means any of the following events or conditions which has a material and <br />89 adverse effect on the performance by the Parties of their respective obligations under this <br />90 Agreement: <br />91 a. The enactment, adoption, promulgation, issuance, modification, or written change in <br />92 administrative or judicial interpretation on or after January 1, 2011 of any Applicable <br />93 Law; or <br />94 b. The order or judgment of any governmental body, on or after January 1, 2011, to the <br />95 extent such order or judgment is not the result of willful or negligent action, error or <br />96 omission or lack of reasonable diligence of the Agency, or of the Contractor, whichever <br />97 is asserting the occurrence of a Change in Law; provided, however, that the contesting <br />98 in good faith or the failure in good faith to contest any such order or judgment shall not <br />99 constitute such a willful or negligent action, error or omission or lack of reasonable <br />100 diligence. <br />101 Charge <br />102 "Charge" means the amount payable to Contractor for providing any additional service to <br />103 Customers and Agencies specified in Attachment Q. <br />104 Collect/Collection <br />105 "Collect" or "Collection" means to take physical possession, transport, and remove Solid Waste, <br />106 Targeted Recyclable Materials, Organic Materials, or other materials pursuant to this Agreement <br />107 within and from Agency. <br />108 Collection Container <br />109 "Collection Container" means any Container provided by Contractor to store and Collect Solid <br />110 Waste, Targeted Recyclable Materials, Organics, or any other material targeted for Collection <br />111 by Contractor or subcontractor of Contractor. <br />112 Commencement Date <br />113 "Commencement Date" means the date specified in Section 3.01 when the Contractor is to <br />114 begin providing services under the terms and conditions of this Agreement. <br />Franchise Agreement for Collection Services with Recology San Mateo County Attachment A <br />City of Redwood City Definitions <br />REV: 03-16-18 MI Page 3 of 18 <br />ATTY/AGR.2018.054/Recology of San Mateo <br />
