227 Effective Date <br />228 "Effective Date" means the date identified in Section 3.01 when this Agreement becomes <br />229 binding and enforceable. <br />230 Electronic Waste (or E -Scrap) <br />231 "Electronic Waste" or "E -Scrap" means "Covered Electronic Wastes" as defined in the Act <br />232 (Section 42463 of Public Resources Code) in addition to discarded electronic equipment such <br />233 as, but not limited to, television sets, computer monitors, central processing units (CPUs), laptop <br />234 computers, and peripherals (e.g., external computer hard drives, computer keyboards, computer <br />235 mice, and computer printers). E -Scrap does not include those items defined herein as Targeted <br />236 Recyclable Materials. <br />237 Environmental Laws <br />238 "Environmental Laws" means all federal and State statutes, County, and Agency ordinances <br />239 concerning public health, safety and the environment including, by way of example and not <br />240 limitation, the Act, the Comprehensive Environmental Response, Compensation and Liability <br />241 Act of 1980, 42 USC §9601 et seq.; the Resource Conservation and Recovery Act, 42 USC <br />242 §6902 et seq.; the Federal Clean Water Act, 33 USC §1251 et seq.; the Toxic Substances <br />243 Control Act, 15 USC §1601 et seq.; the Occupational Safety and Health Act, 29 USC §651 et <br />244 seq.; the California Hazardous Waste Control Act, California Health and Safety Code §25100 et <br />245 seq.; the California Toxic Substances Control Act, California Health and Safety Code §25300 et <br />246 seq.; the Porter -Cologne Water Quality Control Act, California Water Code §13000 et seq.; the <br />247 Safe Drinking Water and Toxic Enforcement Act, California Health and Safety Code §25249.5 et <br />248 seq.; as currently in force or as hereafter amended, and all rules and regulations promulgated <br />249 thereunder. <br />250 Facility/Facilities <br />251 "Facility/Facilities" means any plant or site, owned or leased and maintained, operated or used <br />252 by Contractor for purposes of performing Contractor's obligations under this Agreement (e.g., <br />253 facilities for parking and maintaining vehicles, administration offices, and customer service <br />254 offices, etc.). As of the Effective Date, Contractor's Facility(ies) are Shoreway Recycling and <br />255 Disposal Center at 225 Shoreway Road, San Carlos, California. <br />256 Fiscal Year <br />257 "Fiscal Year" means the period commencing July 1 through June 30 each year. <br />258 Food Scraps <br />259 "Food Scraps" means a subset of Organic Materials including: (i) all kitchen and table food <br />260 waste, and animal, or vegetable fruit, grain, dairy or fish waste that attends or results from the <br />261 storage, preparation, cooking or handling of foodstuffs, with the exception of animal excrement, <br />262 (ii) paper waste contaminated with putrescible material, and (iii) biodegradable BPI -certified' <br />263 plastic food service ware (where BPI refers to the Biodegradable Products Institute and more <br />264 information can be found at http://www.bpiworld.org/science-of-composting). <br />265 Franchise Fee <br />266 "Franchise Fee" means the fee paid by Contractor to Agency pursuant to Section 10.02. <br />Franchise Agreement for Collection Services with Recology San Mateo County Attachment A <br />City of Redwood City Definitions <br />REV: 03-16-18 MI Page 7 of 18 <br />ATTY/AGR.2018.054/Recology of San Mateo <br />
