ATTY/AGR.2018.054/Recology of San Mateo <br />Event of Non - <br />Performance <br />Customer Service <br />Qualit_ <br />Untime�y Resolution <br />of Complaints and <br />Inquiries <br />Reporting <br />Late Submittal of <br />Reports, <br />Application, <br />Proposal, or Other <br />Submittals <br />Acceptable Performance Level <br />No failures or Complaints in this category <br />are acceptable; therefore, any Complaint <br />of this nature shall be considered <br />unacceptable. <br />Report, application or proposal shall be <br />submitted on the date or in accordance <br />with the timeframe specified in this <br />Agreement. <br />Collection Services Franchise Agreement with Recology San Mateo County <br />City of Redwood City <br />REV: 03-16-18 MI <br />TABLE 1 <br />Definition of Complaint, Incident, or <br />Event <br />Each failure to resolve or remedy a <br />Complaint or Inquiry within ten (10) <br />Business Days of receipt of Complaint or <br />Inquiry pursuant to Section 7.02.D, with <br />the exception of missed pick-ups which <br />are addressed in Attachment I or other <br />service related events that have <br />Liquidated Damages associated with <br />them. <br />For each day Contractor fails to submit: (i) <br />reports in the timeframe specified in <br />Article 9, (ii) Application for determination <br />of Contractors Compensation in the <br />timeframe specified in Article 11; (iii) <br />proposal requested by Agency for change <br />in service in the timeframe specified in <br />Article 9; and (iv) other submittals <br />required by this Agreement in the <br />timeframe specified in this Aqreement. <br />Tracking Method <br />Contractor shall <br />document all <br />Complaints and <br />Inquiries including <br />the date of <br />response <br />pursuant to <br />Section 7.02.D, <br />and, upon <br />request, shall <br />provide detailed <br />reports for the <br />Agency's review. <br />Contractor's <br />submittal dates <br />shall be recorded <br />and compared to <br />the submittal <br />requirements of <br />the Agreement <br />Liquidated <br />Damage <br />Amount <br />$100 per <br />incident <br />$250 per day <br />for each day <br />report is <br />overdue <br />Attachment 1 <br />Liquidated Damages <br />Page 9 of 12 <br />
