ATTACHMENT K <br />CONTRACTOR'S COMPENSATION AND RATE SETTING PROCESS <br />6. Application for Contractor's Compensation Adjustment <br />Contractor is required to submit an Application for Contractor's Compensation Adjustment <br />(Application) annually by June 15 for determination of Contractor's Compensation for the <br />following Rate Year commencing with its Application for Rate Year Eleven (2021) Contractor's <br />Compensation, which is due June 15, 2020. This Section describes the content of the Application. <br />A. Reoortina of Operational Information <br />Operational information shall be reported in total as well as disaggregated by each Line of <br />Business, by Service Sector, and by Member Agency. The information shall be submitted on <br />forms provided by Contractor and approved by SBWMA. Operational information to be <br />provided includes, but is not limited to, the following: <br />• Tonnage Collected by Line of Business; <br />• Number of accounts by Line of Business and account type (i.e., Container size, Collection <br />frequency, and material type); <br />• Number of accounts, lifts, and pulls needed to perform the average service level <br />adjustment calculations (described in Section 4); <br />• Number of Containers in service by Line of Business; <br />• Set -out rates by Line of Business; <br />• Number of routes and annual route hours by Line of Business; <br />• Number and type of vehicles by Line of Business; <br />• Annual route labor hours by Line of Business; and, <br />• Roster of all personnel by category including direct, indirect, and general and <br />administrative (G&A). <br />B. Audited Financial Statements <br />Financial statements (balance sheet, income and expense statement) for the operations <br />covered by this Agreement for Contractor's immediately preceding fiscal year (October 1— <br />September 30) shall be submitted with the Application. The financial statements shall be <br />accompanied by a report of an independent Certified Public Accountant licensed by the <br />California Board of Public Accountancy stating that (i) it has audited the financial statements <br />in accordance with auditing standards generally accepted in the United States, and (ii) in its <br />opinion the financial statements present fairly, in all material respects, the financial position <br />of Contractor as of September 30 of the year under review and of the immediately <br />preceding year, and the changes in its financial position for the years then ended in <br />conformity with United States generally accepted accounting principles. <br />The Certified Public Accountant's report shall also contain a separate statement identifying <br />the amounts of audited revenue and expense that are attributable to the last nine months <br />of the Contractor's fiscal year (January - September 30). <br />In addition, Contractor shall submit financial statements covering the last three months of <br />the preceding calendar year (October 1 - December 30) and a compiled twelve (12) month <br />statement covering the preceding calendar year.
