938 Contractor may reject any individual item that weighs more than two -hundred (200) <br />939 pounds (excluding Major Appliances) unless Customer has paid, or has agreed in <br />940 advance to pay, an additional fee for service at Agency -approved Charges specified <br />941 in Attachment Q. Contractor may reject un -containerized Discarded Materials with <br />942 the exception of Major Appliances, Bulky Items, E -Scrap, and large pieces of <br />943 Organic Material such as tree limbs and dimensional lumber. <br />944 E. Recycling and Reuse. Contractor shall Collect materials in a manner that <br />945 maximizes reuse, Recycling, composting, and diversion of materials from Disposal. <br />946 Contractor shall make reasonable efforts to ensure that diversion goals are met or <br />947 exceeded. Disposal of materials shall be the Contractor's last option. At a <br />948 minimum, Contractor shall divert from Disposal: cardboard, E -Scrap, useable <br />949 furniture, Major Appliances, mattresses, Organic Materials, wood waste, and other <br />950 reusable or Recyclable Materials. <br />951 F. Handling Major Appliances. Major Appliances, Universal Waste, and E -Scrap <br />952 shall be reused, Recycled, or Disposed by Contractor in accordance with <br />953 requirements of Applicable Law. Any changes to such regulations made after <br />954 January 1, 2011 shall be addressed as though they are a Change in Law in <br />955 accordance with Section 11.05. <br />956 G. Collection and Processing Methods. All materials that can be handled by the <br />957 SFD Single -Stream Recycling, Organic Materials, or Solid Waste route Collection <br />958 vehicle would be assigned to one of these vehicles for Collection, with the goal of <br />959 maximizing diversion. All Collection of Bulky Items will be assigned for Collection by <br />960 a Collection vehicle, and the driver will segregate items Collected according to their <br />961 suitability for: (1) reuse or Recycling, and (2) Disposal, prior to their transport to <br />962 Shoreway Recycling and Disposal Center for processing. Any remaining items will <br />963 be Collected by a dispatched Collection vehicle. Contractor shall utilize these <br />964 procedures and vehicles in a manner that provides the maximum diversion of the <br />965 material Collected from the On -Call Bulky Item Collection Service event. <br />966 H. Maximum Number of Daily Events. Contractor shall schedule up to a maximum <br />967 of one hundred fifty (150) On -Call Curbside Bulky Item Collection Service events <br />968 per service day for the SBWMA Service Area ("daily limit"). The maximum number <br />969 of daily events includes On -Call Bulky Item Collection Service events provided to <br />970 both Single -Family and Multi -Family Residential Complexes, and those events <br />971 provided at no charge and events paid for by the Customer, Owner, or property <br />972 manager. Contractor shall schedule On -Call Curbside Bulky Item Collection Service <br />973 events no more than ten (10) Business Days after the Owner's or Occupant's <br />974 request up to the maximum number of daily events. Upon reaching the maximum <br />975 number of daily events, requested On -Call Curbside Bulky Item Collection Service <br />976 event shall be scheduled on the next available regularly scheduled Solid Waste <br />977 Collection Day. <br />978 SBWMA may adopt an allocation system for On -Call Bulky Item Collection Service <br />979 events, in order to allocate the "daily limit" for such events among Member <br />980 Agencies. If adopted, Contractor shall comply with the allocation system. <br />981 The Agency agrees not to assess Liquidated Damages if Contractor does not meet <br />982 the ten (10) Business Day requirement if the delay has resulted from (i) the volume <br />983 of On -Call Bulky Item Collection events being in excess of the "daily limit" for the <br />REV: 03-16-18 MI <br />Page 25 of 126 <br />ATTY/AGR.2018.054/Recology of San Mateo <br />
