1245 5.14 MIXED USE BUILDINGS <br />1246 A. General. Contractor shall provide Solid Waste, Targeted Recyclable Materials, and <br />1247 Organic Materials Collection services to Mixed Use Building Customers in <br />1248 accordance with the requirements for provision of these services to Commercial <br />1249 Customers pursuant to Sections 5.02.C, 5.03.1), and 5.04.C. Contractor shall work <br />1250 cooperatively with the Owner or property manager of the Mixed Use Building to <br />1251 agree on the type and size of Containers to be provided and whether or not the <br />1252 Commercial and Residential portions of the Mixed Use Building will share service or <br />1253 have designated Containers for Collection. <br />1254 B. Service Capacity. For the Residential Premises of the Mixed Use Buildings, <br />1255 Contractor shall provide no less than ninety-six (96) gallons per week of Solid <br />1256 Waste Container capacity for every five (5) Residential dwelling units. At a <br />1257 minimum, Contractor shall provide twenty (20) gallons per week of Container <br />1258 capacity for Single -Stream Targeted Recyclable Materials Collection for every <br />1259 Residential dwelling at the Mixed Use Building. <br />1260 C. Recycling Tote Bags. Contractor shall provide the Residential Premises units of <br />1261 the Mixed Use Building with Recycling Tote Bags in accordance with the Multi - <br />1262 Family Recycling Tote Bags requirements pursuant to Section 5.03.C.2. <br />1263 D. Household Battery and Cell Phone Collection. Contractor shall provide the <br />1264 Residential Premises of the Mixed Use Building with Household Battery and Cell <br />1265 Phone Collection in accordance with the Multi -Family Household Battery and Cell <br />1266 Phone Collection service requirements pursuant to Section 5.03.C.3. <br />1267 E. Bulky Item Collection. Contractor shall provide the Residential Premises of the <br />1268 Mixed Use Building with two (2) annual On -Call Bulky Item Collection Service <br />1269 events per Mixed Use Building in accordance with the Multi -Family On -Call Bulky <br />1270 Item Collection service requirements pursuant to Section 5.05. Such service must <br />1271 be requested by the Owner or property manager. <br />1272 F. Recycling Promotion. Contractor shall provide the Residential Premises of the <br />1273 Mixed Use Building with the Recycling promotion services that are provided to <br />1274 Multi -Family Dwellings under Section 7.05, and shall provide the Commercial units <br />1275 of the Mixed Use Building with the Recycling promotion services that are provided <br />1276 to Commercial Premises under Section 7.04. <br />1277 G. Holiday Tree Collection. Contractor shall provide Holiday Tree Collection Service <br />1278 to Residential Premises of the Mixed Use Building in accordance with the Multi - <br />1279 Family Holiday Tree Collection Service requirements in Section 5.04.E. <br />1280 H. Other <br />1281 1. Conflict. The Parties acknowledge that Mixed Use Building is a new category <br />1282 and that Mixed Use Buildings may be coded in Contractor's software system as <br />1283 Multi -Family Residential Complexes, as Commercial Customers, or (in the <br />1284 event of separate accounts for the Residential and Commercial parts of the <br />1285 Premises) as both. In the event of any conflict between the provisions of this <br />1286 Agreement relating to Mixed Use Buildings, on the one hand, and those <br />1287 relating to Multi -Family Residential Complexes or Commercial Premises, on the <br />1288 other hand, the provisions relating to Mixed Use Buildings shall govern. <br />REV: 03-16-18 MI <br />Page 32 of 126 <br />ATTY/AGR.2018.054/Recology of San Mateo <br />
