1891 Upon request from Agency or SBWMA, the general manager or his/her designee is <br />1892 required to meet quarterly, and more frequently if necessary, with Agency and/or <br />1893 SBWMA staff to review public education and promotion activities. In addition, the <br />1894 general manager or his/her designee shall be required to represent Contractor at all <br />1895 monthly SBWMA Board of Director meetings. <br />1896 H. Agency Rights <br />1897 Contractor acknowledges that the public education and promotion activities listed <br />1898 are critical to the success of Agency's diversion performance relative to the Act and <br />1899 other State legislation/regulations (such as, but not limited to, AB 341, AB 1594, AB <br />1900 1826, SB 1061, and SB 1383). As such, Contractor acknowledges Agency's rights <br />1901 to the following: <br />1902 1. Contractor shall make available to Agency and SBWMA all public educational <br />1903 materials used by Contractor, which Agency and SBWMA shall approve prior to <br />1904 their use; <br />1905 2. Agency and SBWMA shall retain the right to modify, expand, or reduce the <br />1906 minimum public education requirements; <br />1907 3. Agency may require Contractor to work with a public education consultant <br />1908 selected by Agency or the SBWMA; <br />1909 4. Agency may perform, or request that the SBWMA perform on its behalf, the <br />1910 public education efforts assigned to the Contractor; and, <br />1911 5. Agency or SBWMA may provide additional, supplemental public education <br />1912 materials as it deems appropriate. <br />1913 I. Reporting Requirements <br />1914 Contractor shall prepare and submit reports related to its public education activities <br />1915 as provided in Article 9. <br />1916 J. Service Notice <br />1917 Contractor shall periodically prepare and distribute to each Customer a notice listing <br />1918 Agency -approved Rates for standard Collection services, Agency -approved <br />1919 Charges for other services, annual Holiday Collection Schedule, and a general <br />1920 summary of services required under this Agreement to be provided Customers and <br />1921 optional services which may be furnished by Contractor. Such notice shall be <br />1922 approved by the Agency prior to distribution. <br />1923 7.04 COMMERCIAL RECYCLING PROMOTION PROGRAM <br />1924 A. Commercial Recycling Promotion Program Staff. Contractor shall maintain a <br />1925 Commercial Recycling promotion program staff that will be primarily responsible for <br />1926 supporting Commercial, Mixed Use Building, and Multi -Family Dwelling Accounts <br />1927 and Agency Facilities Recycling -related and Organics -related Collection services. <br />1928 The Commercial Recycling promotion staff for the SBWMA Service Area shall <br />1929 consist of Waste Zero Specialists (recycling coordinators), as specified in <br />1930 Attachment O. <br />1931 Contractor shall notify Agency and SBWMA within ten (10) Business Days if any of <br />1932 the Waste Zero Specialists resigns or is terminated from employment, and shall use <br />REV: 03-16-18 MI <br />Page 48 of 126 <br />ATTY/AGR.2018.054/Recology of San Mateo <br />
