3279 data retention and preservation systems which can establish where Solid Waste <br />3280 Collected in the Service Area was delivered for transfer or Disposal. This provision <br />3281 shall survive the expiration of this Agreement. <br />3282 F. Compilation of Information for State Law Purposes. Contractor shall compile <br />3283 information on amounts of Solid Waste delivered to the Designated Transfer and <br />3284 Processing Facility and to other locations, as well as other information which the <br />3285 Agency may reasonably request. <br />3286 Contractor shall maintain these records for a minimum of ten (10) years after <br />3287 expiration or earlier termination of the Agreement. Contractor shall provide these <br />3288 records to Agency (upon request or at the end of the record retention period) in an <br />3289 organized and indexed manner rather than destroying or Disposing of them. <br />3290 9.04 GENERAL REPORTING REQUIREMENTS <br />3291 <br />A. Purpose. Records shall be maintained and retained in forms, on media, and by <br />3292 <br />methods that facilitate flexible use of data contained in them to structure reports, as <br />3293 <br />needed. Reports are intended to compile recorded data into useful forms of <br />3294 <br />information that can be used to, among other things: <br />3295 <br />1. Evaluate Diversion performance <br />3296 <br />2. Evaluate Contractor's performance <br />3297 <br />3. Monitor Customer participation in Targeted Recyclable Materials and Organic <br />3298 <br />Materials Collection programs and in other programs using several different <br />3299 <br />performance measures <br />3300 <br />4. Monitor changes in the number of Customers and Customers' service levels <br />3301 <br />5. Determine needs for adjustment to programs and cost for such changes <br />3302 <br />6. Evaluate customer service and Complaints <br />3303 <br />7. Determine and set Contractor's Compensation and Rates <br />3304 <br />B. Report Format. Contractor may propose report formats that are responsive to the <br />3305 <br />objectives and audiences for each report. The format of each report shall be <br />3306 <br />approved by Agency. The Agency may review and request changes to Contractor's <br />3307 <br />report formats and content and Contractor shall not unreasonably deny such <br />3308 <br />requests. Contractor agrees to submit all reports by e-mail in a format compatible <br />3309 <br />with the Agency's software and computers so the Agency can sort and analyze <br />3310 <br />data. Contractor shall provide a certification statement, under penalty of perjury by <br />3311 <br />the responsible Contractor official, that the report being submitted is true and <br />3312 <br />correct to the best knowledge of such official after their reasonable inquiry. <br />3313 C. Submittal Schedule and Instructions. Contractor shall submit monthly reports <br />3314 within fifteen (15) Days after the end of the reporting month, quarterly reports within <br />3315 thirty (30) Days after the end of the reporting quarter, and annual reports within <br />3316 forty-five (45) Days after the end of the reporting year. Contractor shall submit (via <br />3317 e-mail) all reports to the person(s) designated by SBWMA and Agency. Each <br />3318 quarterly report shall be in lieu of the monthly report for the third month of the <br />3319 quarter; thus, Contractor shall submit a total of thirteen (13) periodic reports per <br />3320 year: eight (8) monthly reports, four (4) quarterly reports, and one (1) annual report. <br />REV: 03-16-18 MI <br />Page 80 of 126 <br />ATTY/AGR.2018.054/Recology of San Mateo <br />
