This provision
3281 shall survive the expiration of this Agreement.
3282 F. Compilation of Information for State Law Purposes. Contractor shall compile
3283 information on amounts of Solid Waste delivered to the Designated Transfer and
3284 Processing Facility and to other locations, as well as other information which the
3285 Agency may reasonably request.
3286 Contractor shall maintain these records for a minimum of ten (10) years after
3287 expiration or earlier termination of the Agreement. Contractor shall provide these
3288 records to Agency (upon request or at the end of the record retention period) in an
3289 organized and indexed manner rather than destroying or Disposing of them.
3290 9.04 GENERAL REPORTING REQUIREMENTS
3291
A. Purpose. Records shall be maintained and retained in forms, on media, and by
3292
methods that facilitate flexible use of data contained in them to structure reports, as
3293
needed. Reports are intended to compile recorded data into useful forms of
3294
information that can be used to, among other things:
3295
1. Evaluate Diversion performance
3296
2. Evaluate Contractor's performance
3297
3. Monitor Customer participation in Targeted Recyclable Materials and Organic
3298
Materials Collection programs and in other programs using several different
3299
performance measures
3300
4. Monitor changes in the number of Customers and Customers' service levels
3301
5. Determine needs for adjustment to programs and cost for such changes
3302
6. Evaluate customer service and Complaints
3303
7. Determine and set Contractor's Compensation and Rates
3304
B. Report Format. Contractor may propose report formats that are responsive to the
3305
objectives and audiences for each report. The format of each report shall be
3306
approved by Agency. The Agency may review and request changes to Contractor's
3307
report formats and content and Contractor shall not unreasonably deny such
3308
requests. Contractor agrees to submit all reports by e-mail in a format compatible
3309
with the Agency's software and computers so the Agency can sort and analyze
3310
data. Contractor shall provide a certification statement, under penalty of perjury by
3311
the responsible Contractor official, that the report being submitted is true and
3312
correct to the best knowledge of such official after their reasonable inquiry.
3313 C. Submittal Schedule and Instructions. Contractor shall submit monthly reports
3314 within fifteen (15) Days after the end of the reporting month, quarterly reports within
3315 thirty (30) Days after the end of the reporting quarter, and annual reports within
3316 forty-five (45) Days after the end of the reporting year. Contractor shall submit (via
3317 e-mail) all reports to the person(s) designated by SBWMA and Agency. Each
3318 quarterly report shall be in lieu of the monthly report for the third month of the
3319 quarter; thus, Contractor shall submit a total of thirteen (13) periodic reports per
3320 year: eight (8) monthly reports, four (4) quarterly reports, and one (1) annual report.
REV: 03-16-18 MI
ATTY/AGR.2018.054/Recology of San Mateo
