3321 D. Failure to Report. The refusal or failure of Contractor to file any required reports, <br />3322 or to provide required information to Agency, or the inclusion of any materially false <br />3323 or misleading statement or representation by Contractor in such report shall be <br />3324 deemed a Contractor default as described in Section 14.01 subject to the notice and <br />3325 cure provisions of that section and shall subject Contractor to all remedies which <br />3326 are available to the Agency under the Agreement or otherwise. <br />3327 E. Accuracy of Reports. The failure of Contractor to file accurate and timely reports, <br />3328 proposal(s), information, or correspondence to Agency or SBWMA, or the inclusion <br />3329 of any inaccurate or misleading data, statement or representation by Contractor in <br />3330 such report(s), proposal(s), information, or correspondence to Agency or SBWMA, <br />3331 shall be subject to Liquidated Damages as set forth in Attachment J. In addition, the <br />3332 inclusion of any materially false or misleading statement or representation by <br />3333 Contractor in such report shall be deemed a Contractor default as described in <br />3334 Section 14.01 subject to the notice and cure provisions of that Section and shall <br />3335 subject Contractor to all remedies which are available to the Agency under the <br />3336 Agreement or otherwise. <br />3337 F. Source Files. Contractor shall provide the SBWMA the following information: (i) <br />3338 with each monthly or quarterly report, a spreadsheet provided by Operator showing <br />3339 all Tonnages Collected by Contractor and delivered to the Shoreway Recycling and <br />3340 Disposal Center from Member Agencies during the reporting month, listed <br />3341 separately by Member Agency, material type, and Service Sector; (ii) with each <br />3342 monthly or quarterly report, a spreadsheet containing the information required by <br />3343 Sections 9.06.B, 9.06.D, and 9.06.E; and, (iii) with each annual report, a <br />3344 spreadsheet containing the information required by Section 9.07.B. Such <br />3345 information need not be included in the published reports provided to Agency. <br />3346 9.05 MONTHLY REPORTS <br />3347 Monthly reports shall present the information described in this Section in a format agreed <br />3348 upon by the Agency. <br />3349 A. Tonnage Information. Contractor shall provide the Tonnage information requested <br />3350 below by Service Sector on a monthly and year-to-date basis, with a comparison to <br />3351 the prior year. However, the Agency reserves the right to request the monthly <br />3352 Tonnage data by route. <br />3353 1. Solid Waste. Total Solid Waste Tonnage Collected and Disposed by Service <br />3354 Sector. <br />3355 2. Taroeted Recvclable Materials Services. Total Targeted Recyclable Materials <br />3356 Tonnage Collected and delivered for processing by Service Sector listed <br />3357 separately by material type Collected (e.g., Single -Stream Recyclable <br />3358 Materials, Source Separated cardboard, Source Separated paper, Used Motor <br />3359 Oil, Used Motor Oil Filters, etc.). <br />3360 3. Oroanic Materials Services. Total Organic Materials Tonnage Collected and <br />3361 delivered for processing by Service Sector listed separately by material type <br />3362 (e.g., Plant Materials, Food Scraps, or Organic Materials). <br />3363 B. Diversion Level.
