The attached proposal includes a scope of work for Block One only. Per the terms of the <br />DDA, the developer will fund these services. It is anticipated that this work will begin if the <br />Agency Board approves the proposed amendments to the DDA, which are expected to <br />come before the Board in late September or early October. <br /> <br />Cutler & Associates are experienced land acquisition and real estate consultants and have <br />worked throughout the State of California and in the San Francisco Bay area for over 20 <br />years. They have offices in both Oakland and San Jose. The project manager for the <br />Downtown Retail-Cinema project will be a local peninsula resident and member of their <br />staff. Their project team is comprised of Pacific Relocation Consultants, Desmond <br />Marcello and Amster, Hulberg & Associates. All of these firms have extensive experience <br />with redevelopment projects. <br /> <br />BHV Innisfree Ventures I, LLC and their development team have reviewed the proposal <br />from Cutler & Associates and have indicated their support of the proposal including the <br />scope of work and budget. <br /> <br />The Law Offices of Herman H. Fitzgerald have been assisting the Redevelopment Agency <br />for a number of years with eminent domain matters. The firm's practice is limited to the tdal <br />and preparation of eminent domain and inverse eminent domain matters, including all <br />discovery, law and motion matters and appellate procedures relating thereto. The hourly <br />rate for the firm's attorneys is $220.00. Agency General Counsel has contacted references <br />provided by the firm and all have recommended their services. <br /> <br />Fiscal Impact <br />Per the terms of the DDA, the master developer for the project, BHV Innisfree Ventures I, <br />will fund the costs of this proposal for land acquisition and real estate consulting services <br />as well as for eminent domain counsel services. The $337,000 recommended cost includes <br />the Agency's and City's standard 10% administrative overhead. There will be no fiscal <br />impact to the Agency. <br /> <br />P~tricia <br /> J.
