Box 391 Redwood City, CA 94064 Re: Redevelopment A~encv of the City of Redwood Ci_ty Legal Services Contract Dear Damien: This letter is intended to set forth the ~erms of your engagement of this finn for legal services for the Redevelopment Agency of the City of Redwood City, and to constitute our contract for such services as required by Section 6148 of the California Business and Professions Code a copy of which is attached as Exhibit "A" for your information. If at any time you have any questions with regard to this contract or our fees, we encourage you to contact us. This finn will represent the Redevelopment Agency of the City of Redwood City ("Client") in all matters relating to and/or arising from various projects of the Redevelopment Agency of the City of Redwood City on the following terms and conditions: (1) Scone of Services. This firm will provide special legal services and act as special counsel for eminent domain matters on projects and/or properties as assigned consisting of, but not limited to, the preparation and conduct of all eminent domain matters and proceedings in acquiring certain property interests by or in lieu of eminent domain arising out of the projects as assigned including, but not limited to, pre-trial consultation and representation and legal advice, trial and appeal, if any, and such other special services related to eminent domain activity. This firm will use its best efforts in representing Client, but both acknowledge that this firm has given no assurances regarding the outcome of any matters. (2) Client's Responsibilities. Client agrees to co-operate fully and to provide this firm with all information known by or available to Client which may aid in representing Client in these matters. Client agrees that it will furnish, without expense to this firm, all necessary reports, studies, appraisals, etc., and will provide necessary expert consultants which may be required in connection therewith. This firm agrees that it will not, without express written consent, procure any such services or purport to obligate Client to the payment of any fees, costs or expenses in connection therewith. (3) Comvensation. Client agrees to Pay the Law Offices of Herman H. Fitzgerald at the rate of $220.00 per hour for work rendered in connection with the above-entitled matter.
