Brower <br />Assistant City Attorney <br />City of Redwood City <br />May 10, 2002 <br />Page2 <br /> <br />Paralegal costs shall be billed at $65.00 per hour. <br /> <br /> (a) Costs of transportation, meals and lodging incurred in the representation of <br />Client under this contract shall be reimbursed to Law Offices of Herman H. Fitzgerald based upon <br />actual costs incurred and supported by detailed expense records. Client shall be responsible for all <br />costs incurred in connection with these matters, including such items as expert witness fees, <br />photographs, maps and documents, filing fees, jury fees, attorney's telephone and travel expenses, <br />and other items of costs and expenses generally necessary for the preparation and presentation of <br />the cases at trial. These costs and fees will be advanced by attorney and reimbursed as billed. <br /> <br /> (b) Costs and expenses directly connected with the performance of this firm's duty <br />under the contract, including but not limited to, telephone calls, facsimile transmissions, <br />photocopying and reproduction of documents, filing fees, jury fees, reporter's fees, costs of <br />services borne by the Client shall be reimbursed upon submission of itemized statements from this <br />Firm. <br /> <br /> (4) Method of Payment. The compensation of this firm shall be paid by Client <br />monthly, and within thirty days after the billing date, upon receipt of a detailed form of bill setting <br />forth services performed, the amount of time spent and the actual date. This firm shall maintain <br />adequate records of dates and times worked on these matters covered by this contract which records <br />shall be opened at any reasonable time for inspection on behalf of Client. <br /> <br /> (5) Maior Exoenses. Any major expenses, including obligations of expert witnesses, <br />shall not be incurred without Client's prior consent; however, attorney retains the right to approve <br />the hiring of any expert witness for presentation of the cases. <br /> <br /> (6) Discharee and Withdrawal. Client may discharge this firm at any time. This <br />firm may withdraw at any time. Both agree to sign any documents reasonably necessary to <br />complete this fh-m's discharge or withdrawal. <br /> <br /> If the above provisions are acceptable, please indicate Client's approval in the space provided <br />on the enclosed copy of this letter and return it in the enclosed, self-addressed envelope.
