REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br /> <br />June 25, 2018 <br /> <br />SUBJECT <br />Levy of Benefit Assessments for Fiscal Year 2018-2019 for the Seaport Centre <br />Maintenance District <br /> <br />RECOMMENDATION <br />Adopt a resolution to order the Levy and Collection of Benefit Assessments for FY <br />2018-2019 for the Seaport Centre Maintenance District in the amount of $187,000 and <br />find that the project is exempt from the requirements of the California Environmental <br />Quality Act (CEQA) under CEQA Guidelines Section 15301 (Existing Facilities) <br /> <br />BACKGROUND <br />The Seaport Centre Maintenance District (District) was formed to pay for the <br />maintenance of facilities that were determined to require a level of service greater than <br />regularly required. The District was established in 1987 to pay for the maintenance of <br />stormwater pump stations, levee systems, and utilities in easements that benefit the <br />parcels within the District. <br />On June 8, 2015, the City Council accepted the City Manager’s and Engineer’s Reports <br />(Reports) that describes the annual maintenance work, costs, and budget of the <br />District. The reports also established the formula by which the annual special benefits <br />assessments will be calculated against each assessed parcel for an aggregate amount <br />not to exceed $187,000 annually. <br />On August 24, 2015, property owners of the District approved, by a vote of 100% yes to <br />0% no, the Reports, the levy and distribution of the annual special benefit assessment <br />of $187,000 for the parcels within the District. On the same date, the Council adopted a <br />resolution approving the proposed assessments and authorizing the County to levy and <br />collect the assessments. It was approved that the assessment would be levied <br />annually, without additional mail ballot proceedings, so long as maintenance expenses <br />are incurred. The rate of the assessment may not be increased above the rate shown <br />on the ballot without an additional mail ballot proceeding. <br /> <br />ANALYSIS <br />The District is annually assessed to allow taxes to be levied and collected by the San <br />6.3.B. - Page 1
