WHEREAS, on May 21, 2018, the City Council held a duly -noticed public <br />hearing on the Zoning Amendment and the Municipal Code Amendment <br />(collectively, the "Amendments") and considered the staff reports, oral and <br />written, and testimony and materials presented by all those wishing to be heard <br />on the Amendments at the public hearing on this matter. <br />NOW, THEREFORE, THE COUNCIL OF THE CITY OF REDWOOD <br />CITY DOES ORDAIN AS FOLLOWS: <br />Section 1. The foregoing recitals are true and correct, are hereby <br />incorporated herein by this reference as if fully set forth in their entirety, and <br />constitute findings in this matter. <br />Section 2. The City Council hereby finds that the proposed Amendments <br />are in the public interest and consistent with the Redwood City General Plan as <br />described in the accompanying staff report. <br />Section 3. These proposed Amendments have been reviewed with <br />respect to applicability of the California Environmental Quality Act ("CEQA") and the <br />State CEQA Guidelines (California Code of Regulations, Title 14, Sections 15000 et <br />seq.). Passage of the Amendments is not considered a project under Public <br />Resources Code Section 21065 and CEQA Guidelines Section 15378, because the <br />activity will not result in a direct or reasonably foreseeable indirect physical change <br />in the environment. In addition, the Amendments are exempt from CEQA as it can <br />be seen with certainty that there is no possibility for causing a significant effect on <br />the environment (CEQA Guidelines Section 15061(b)(3)) as described in the staff <br />report. Pursuant to CEQA Guidelines Section 15091(e), the documents and other <br />materials that constitute the record of proceedings upon which the City Council has <br />based its decision are located in and may be obtained from the Office of the City <br />Clerk at 1017 Middlefield Road, Redwood City, California. The City Clerk is the <br />custodian of records for all matters before the City. <br />Section 4. The City Council of the City of Redwood City adopts the <br />Zoning Amendment moving existing Article 29 (CO (Commercial Office) District) to <br />Article 12 (Reserved), adding a new Article 29 (Requirements for Affordable <br />Housing), and repealing and replacing Section 32.19 (Affordable Housing Density <br />Bonuses), as shown in Exhibit A, attached hereto and incorporated herein by <br />reference.
