Review Committee on August 13, 2002 and recommended for approval. As with the <br /> previous license agreement with the City for the sidewalk caf6 use on City Hall Plaza, these <br /> private encroachments on public land are considered temporary because they can be <br /> moved within hours of notice by the City. In addition, the original license agreement <br /> specifies that the pdmary use of the land must remain for public activities and that any use <br /> of the property for commercial purposes is secondary to the use of the plaza by the general <br /> public. The term of this license will be for one year, and automatically renew for an <br /> additional year unless revoked by the City or requested by the licensee. As in the previous <br /> agreement, the proposed flower stand cannot interfere with the City's use of the property <br /> as a public space and all related "improvements" must be removed within a 24 hours of <br /> notification by the City. In addition, the City reserves the right to rearrange the proposed <br /> location of the flower stand (as well as the outdoor seating) if it is determined by the City <br /> that the portable structure interferes with the public use, access and/or enjoyment of the <br /> space. <br /> <br /> Staff believes that the City Hall Plaza area will be enhanced by the proposed flower stand <br /> because it is compatible with the existing outdoor caf6 use, should attract more people <br /> downtown and contribute to the animation of this public space.
