6.2.13. - Page 48 <br />These terms apply to the three (3) year warranty and maintenance services period <br />included in the "not to exceed" price for the Project, and to any extended warranty and <br />maintenance services period purchased by the City pursuant to the Agreement. <br />I. Standard Warranty <br />Scheidt & Bachmann (Contractor) guarantees all parts, materials and workmanship <br />during the warranty period of (3) years following the date of beneficial use by the City <br />(Milestone 3). Warranty work due to manufacturer defects will be provided without cost <br />to the City. <br />Contractor expressly warrants that the PARCS systems shall conform to the drawings, <br />specifications, data or other descriptions in the Scope of Work (Exhibit A), will be free <br />from defects in design, material or workmanship, will be fit and sufficient for the <br />purpose or use intended, and are new and unused. This warranty shall continue for a <br />period of three (3) years following the date of beneficial use by the City (Milestone 3). <br />If defective hardware is replaced by Contractor, the warranty terms will be renewed for <br />such replacement hardware. <br />Any PARCS system or component that, within the warranty period: (i) fails to perform in <br />accordance with the specifications in effect at the time of original product shipment or <br />(ii) fails as a result of a defect in material or workmanship, will be repaired or replaced <br />at the option of Contractor without charge to the City. All costs associated with the <br />removal and/or reinstallation of a defective component shall be the responsibility of <br />the Contractor. <br />Warranty Documentation <br />Scheidt & Bachmann will maintain a database detailing installed equipment and <br />inventoried spare parts. This database will maintain an electronic audit trail of all <br />service performed on each piece of equipment.
