6A.B. - Page 32 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />June 25, 2018 <br />SUBJECT <br />Zoning Ordinance Amendment to Allow Commercial Cannabis Delivery Centers and <br />Nurseries in the Commercial Office (CO) Zoning District and Amendment to Municipal <br />Code Chapter 32, Article 7, Division 7 (Regulation of Cannabis Businesses) <br />RECOMMENDATION <br />1. Hold a Public Hearing; <br />2. Waive the First Reading and Introduce an Ordinance Amending Article 59 of the <br />Zoning Ordinance to Allow Delivery Centers and Indoor Nurseries in the CO <br />Zoning District, and find that the project is exempt from the requirements of <br />California Environmental Quality Act (CEQA) under Section 26055(h) of the <br />Business and Professional Code; <br />3. Waive the First Reading and Introduce an Ordinance Amending Chapter 32, <br />Article V, Division 7 of the Municipal Code, and find that the project is exempt <br />from the requirements of CEQA under Section 26055(h) of the Business and <br />Professional Code <br />BACKGROUND <br />On April 9, 2018, the City Council held <br />a public hearing and introduced <br />ordinances that establish regulations <br />related to Cannabis Businesses. <br />These ordinances were adopted on <br />May 7, 2018. The Zoning Ordinance <br />amendment established that cannabis <br />delivery centers are allowed in the <br />industrial zoning districts of IR <br />(Industrial—Restricted), LII (Light <br />Industrial Incubator), IP (Industrial <br />Park), and GI (General Industrial). <br />Delivery centers include storage of <br />cannabis and sales conducted <br />exclusively by delivery.
