6.4.13. - Page 33 <br />nurseries are allowed in the industrial zoning district of IR, LII, IP, and GI with a <br />Conditional Use Permit. Nurseries include cultivation that produces only clones, <br />immature plants, seeds and other products for commercial sales. In addition, the <br />sensitive use buffer was established at 600 feet, which requires that all cannabis uses <br />must be at least this distance from schools, child care centers, youth centers, public <br />parks, and libraries. <br />The Municipal Code amendment established regulations governing nurseries, delivery <br />centers, and deliveries in the City. The regulations created a cannabis business permit <br />that all nurseries and delivery centers located in the City must obtain prior to operating. <br />Additionally, the regulations established operating requirements for such cannabis <br />businesses. As relevant here, the regulations require consideration of the criminal <br />conviction record of a cannabis business permit applicant and the owners, managers, <br />and employees of the applicant's associated cannabis business at the application stage. <br />The regulations do not require review of the circumstances of conviction if the applicant <br />is denied a permit based on a conviction. <br />During the April 9, 2018 public hearing, members of the City Council expressed interest <br />in staff evaluating the Commercial Office zoning district as a potential location for <br />delivery centers and nurseries and return with a recommendation. A map of properties <br />in the CO District is located in Figure 1. Additionally, during the April 9 hearing, <br />questions were raised about the Municipal Code amendment's background check <br />requirements. <br />ANALYSIS <br />There are two types of commercial cannabis activity that would be permitted in <br />Redwood City upon the effective date of the Zoning Ordinance amendment mentioned <br />above in the IR, LII, IP, and GI (industrial) Zoning Districts: <br />• Delivery Centers. Delivery centers allow for storage of cannabis products, call <br />centers to receive orders, and deliveries directly to customers. Individual <br />customers would be prohibited from buying cannabis products "over the counter" <br />similar to a retail use. The state regulates this as a "non -storefront retail" <br />business. <br />• Nurseries. Nurseries are defined as producing only clones, immature plants, and <br />seeds and other agricultural products specifically for planting and propagation. A <br />nursery producing seed for distribution may contain mature plants, but all <br />products, except seed, derived from these plants are prohibited from entering the <br />commercial distribution chain.
