10.A. - Page 59 The Director of Finance is also directed to serve as the City Auditor when Council has not appointed a separate City Auditor. These roles are described across five sections of the Charter. The proposed amendments would streamline the Charter by consolidating the Director of Finance and City Treasurer sections in a revised Section 31. The proposed amendments also clarify that the Director of Finance is a role to be performed, rather than a title of an employee position. (The Director of Finance role is currently performed by the Director of Administrative Services.) Because the Council may appoint a separate City Auditor, the proposed amendments retain a separate Section 33. That section is amended, however, to be consistent with Section 31's mandate that the City Auditor role be performed by the Director of Finance whenever Council has not appointed a City Auditor. Because the roles of City Assessor and City Collector are performed by San Mateo County, the Committee recommends that Sections 35 and 36 be deleted in their entirety. 3) Pavments by the Public Library The Committee recommends an amendment to Section 59 (Payment of City Moneys), which describes the process by which the City pays out money from the treasury. The current section excepts the public library from the generally applicable process, and, as a result, the payments from the library, including payroll obligations and payment on contracts, are processed separately from other City payments. This is likely a provision that was a holdover from before 2009's charter amendment made the library department's operation and administration consistent with other departments of the City. In order to standardize the payment procedure across all City departments, the proposed amendment would remove the provision excepting the public library from normal payment procedures. 4) Citv Contracting Procedures The Committee recommends an amendment to Section 67 (Contracts), which sets forth dollar thresholds related to contracting for public works and improvements. Under the current charter, all contracts for public works or improvements that exceed $10,000 must be executed by contract. All contracts for public works or improvements under $100,000 shall be awarded to the lowest responsible bidder without public advertisement, and those $100,000 or more shall be awarded to the lowest responsible bidder after public advertisement. Because inflation changes the purchasing power of these dollar amounts over time, it is desirable to give the City Council the ability to adjust these thresholds as appropriate. To provide this necessary flexibility, the proposed amendments replace the dollar thresholds with a statement that the conditions and procedures for contracts for public works and improvements, including advertising and bidding requirements, will be Page 6 of 8
