10.A. - Page 58 Together, these amendments remove non -substantive procedural steps associated with budget adoption. They do not alter the substantive information required to be included in the budget, nor do they change the general requirement to make copies of the budget available for inspection by the public or the requirement to hold a public hearing on the budget. Consistent with other proposed amendments, the proposed amendments to Sections 51 and 51.5 also update public noticing requirements associated with budget adoption. Section 51 currently states that copies of the budget do not need to be placed on file with the City Clerk if the Council chooses to publish the budget in the official newspaper. Because the City has no official newspaper and because it is impracticable to print a several hundred -page budget in any newspaper, the proposed amendments remove this reference to newspaper publication. Similarly, where Section 51.5 currently requires notice of the public hearing on the budget and the public availability of the budget to be published in the official newspaper, the proposed amendments require that notice be published in accordance with procedures established by an ordinance of the Council. 5) Gendered Language and Standardized Usage The City Charter reflects the era of its adoption in its use of masculine language to describe City officials and employees. The proposed amendments modernize the language of the Charter by replacing gendered language with neutral language. The proposed amendments also delete current Section 72.5, which explains that references to the masculine gender throughout the Charter should be interpreted as including both masculine and feminine genders. The proposed amendments also standardize capitalization throughout the document and make other conforming, non -substantive changes. Recommended Amendments (First Proposed to the Full Council on June 25, 2018): 1) Appointment of Citv Clerk by City Manager The Committee recommends amendments to Section 21 (Officers and Boards) and Section 32 (City Clerk). Under the current Charter, the City Clerk is appointed directly by the City Council. In order to maximize organizational efficiency, the City Council recommends amending the Charter to provide that the City Clerk will be appointed by the City Manager. This approach is consistent with the approach taken by many other California charter cities. 2) Consolidation of Financial Offices The Committee recommends amendments to Section 31 (Director of Finance), Section 33 (City Auditor), Section 34 (City Treasurer), Section 35 (City Assessor), and Section 36 (City Collector). The City Charter currently provides for a Director of Finance who is directed to perform the duties of the City Treasurer, City Assessor, and City Collector. Page 5 of 8
