10.A. - Page 57 <br />these boards and commissions, the proposed amendments will limit the number of <br />consecutive terms members can serve to four. These limits mirror the existing term <br />limits for City Councilmembers set forth in Section 9a of the Charter. The amendments <br />establish the following with respect to the term limits: <br />A. Partial terms to which a person is appointed to fill a vacancy on any board or <br />commission shall not be included in computing consecutive terms. <br />B. The full term during which a member may resign shall be included in the <br />same manner as if no resignation had taken place. <br />C. If a member is not reappointed after serving one or more terms, such member <br />may be appointed in a later appointment cycle and shall be eligible to serve <br />four consecutive terms from the date of the later appointment. <br />D. Full terms or partial terms served prior to January 1, 2019 shall be included in <br />terms of computing consecutive terms. <br />E. When a member completes a term without being reappointed to the <br />succeeding term, including instances in which a member is not reappointed <br />because they would exceed the term limit, such member shall continue to <br />serve until a successor is appointed and qualified. <br />3) Citv Manager Local Residencv Requirement <br />The Committee recommends amending Section 26 (City Manager). This amendment <br />deletes the local residency requirement for the City Manager in order to comply with <br />State law. Section 26 of the Charter currently states that if the City Manager is not a <br />resident of the City at the time of appointment, he/she shall become and remain a <br />resident of the City promptly after appointment. Section 26 was last amended in 1936. <br />In 1976, Article XI, Section 10 of the California Constitution was amended to prohibit <br />cities from requiring that employees be residents. The proposed amendments conform <br />the Charter to this Constitutional requirement by deleting the residency requirement in <br />Section 26. <br />4) Budget Procedures <br />The Committee recommends amendments to Section 51 (Budget) and Section 51.5 <br />(Adoption of Budget). These proposed amendments reduce the administrative steps <br />required to adopt the annual budget while preserving the same level of transparency <br />and public input. Currently, Section 51 requires the Council to establish, by motion, the <br />date on which the City Manager will submit the budget to the Council for review. The <br />proposed amendments eliminate the need for the Council to take this procedural action <br />and replace it with a requirement that the City Manager submit the budget at least 30 <br />days before the new fiscal year begins. Section 51.5 contains a similar procedural <br />requirement that the budget be adopted by resolution upon a date established by <br />resolution of the Council. The proposed amendments remove this requirement for two <br />separate resolutions and simply require that the budget be adopted by resolution after <br />conclusion of the public hearing. <br />Page 4 of 8 <br />
