10.A. - Page 56 <br />amendments would make the City's public noticing procedures more effective and more <br />responsive to changes in technology and media. Proposed changes to Section 3% <br />amend existing procedure for publishing notice of a proposed sale of property by the <br />Port. Currently this section states that public notice of any such proposed sale shall be <br />advertised in the "official newspaper" of the City. However, the City no longer has a <br />newspaper that meets the requirement for a "newspaper of general circulation" <br />published within city limits, which is a state law requirement for publication of notices. <br />The proposed amendments replace this outdated requirement with a requirement to <br />publish notice in any newspaper of general circulation within the City. <br />Proposed changes to Section 6 amend existing procedure for publishing notice of a <br />deposit of petitions, referenda, or recalls. Currently this section states that the deposit of <br />petitions for initiatives, referenda, or recalls shall be noticed three or more times in a <br />newspaper published and circulated within the City. The proposed amendments replace <br />this with a requirement that notice be published in accordance with procedures <br />established by an ordinance of the Council. This will allow the City to publish notice in <br />compliance with the Charter even though no newspaper of general circulation is <br />currently published within Redwood City. The proposed amendments will also allow the <br />Council to amend noticing procedures for initiatives, referenda and recalls without <br />needing to amend the Charter. <br />Proposed changes to Section 15 and 47d amend existing procedures for publication of <br />ordinances adopted by the City and Port, respectively. Currently these sections require, <br />among other things, that the full text of ordinances be published in the City's "official <br />newspaper." As noted above, the City is unable to comply with these requirements. <br />Moreover, newspapers are unable to publish the full text of lengthier ordinances in their <br />print edition. Even if a newspaper were able to print the full ordinance, the cost to the <br />City would be prohibitive, especially in the case of those lengthier ordinances. <br />The proposed amendments to Section 15 replace these impracticable requirements with <br />a requirement to publish ordinances at least once in accordance with procedures <br />established by an ordinance of the Council. Similarly, with respect to the Port, the <br />proposed amendments to Section 47d, replace the requirement to publish ordinances in <br />the official newspaper with a requirement to publish in accordance with procedures <br />established by an ordinance of the Board of Port Commissioners. These amendments <br />will give the Council and the Board of Port Commissioners latitude to adopt procedures <br />that are most effective in reaching members of the public. It will also allow each body to <br />update publication procedures as technology and media evolve without needing to <br />amend the Charter. <br />2) Term Limits for Boards and Commissions <br />The Committee recommends amendments to Section 17 (Planning Commission), <br />Section 18 (Library Board), 211/2 (Establishment of Boards and Commissions), 47b <br />(Organization: Terms of Office).
