To: The Redwood City Planning Dept.
From: Paul and Marie Nickels
363 Topaz Street, Redwood City
`rc,c
Date: 07/22/2018 rev B We, qA J
Subject: My Neighbor at 375 Topaz Street Plan
to build a 2"d story addition
Letter of Complaint and Opposition to the proposed addition called the " Zirbes Residence "
2"d story addition submitted to the R.W.C. Planning Department by Morris Architecture on 06/19/18.
The primary reasons we bought and moved in our 363 Topaz Street home on 06/15/1987 were:
a) To get away from the 2nd story neighbors we experienced from 1980-1987 in our previous home at 311 D
Street in Redwood City.
b) to get away from the constant psychological feeling of condescension and surveillance a 2nd story
neighbor's visual presence over our property displays.
c) because it had a pool and we swim in the nude with our golden retrievers of which we are on our 3'd Golden
Retriever since 1987.
d) we wanted to spend 10 x the amount of time most families do in the backyard because of the privacy
offered in our new backyard by high fences to: read, build hobbies, barbecue, and swim in the nude.
We are vehemently opposed to any 21 story addition by any neighbors that affects the " Line of Sight View "
into our backyard, sideyards, pool area and front yards because:
a) that would render all 4 of our primary reasons for moving here ineffective and obsolete.
b) it will adversely affect our ability to heat our pool with a solar cover as it will block the east to west travel of
the sun on our pool for many hours of daylight.
c) it violates our fundamental " right to privacy" .
d) we have a Durafoam insulated roof on our southeast roof which makes the southeastern area of our house
cool in the summer and freezing in the winter, and any sunlight blockage will increase our heating bill.
e) the psychological effects of a loss of privacy are devastating. I cannot sleep tonight as I just found out about
this yesterday and can't sleep. So, I finally got up at 3:03 am to write this letter as I am livid, distraught and
inconsolable.
f) we expect to live here until we die in 20-30 years are are NOT willing to endure this loss of privacy.
g) Paul has S.A.D. = seasonal affective disorder November through March due to less sunlight.
h) in 5-10 years when we replace our roof we want to go with solar heating but this idea will be obsolete
if the Zirbes residence is allowed to go upward.
The Zirbes residence existing roof apex already sits about 5 feet above our existing southeastern flat roof.
Some of their existing windows are already above our existing 7 foot tall good neighbor fence and that bugs us.
I did some rough right triangle calculations and found that any build up at all will significantly affect the " Line of
Sight View " into our backyard, sideyard, and most significantly our pool area where we swim unclad.
We respectfully request that a 2nd story addition be denied by the Redwood City Planning Department.
We respect the Zirbes rights to do anything they want to their existing single story house but NOT to build
upward as that affects us. We are exploring legal remedies for this situation.
Respectfully, Paul and Marie Nickels. Our contact ph# is 650-364-4908 = home land line.
