To: The Redwood City Council Date: 07/14/2018 <br />From: Paul and Marie Nickels Subject: Fundamental Design Review Process Flaw <br />363 Topaz Street, Redwood City to build a 2nd story addition in residential areas <br />Letter to Urge the City Council to task the RWC Planning Department <br />with ammending the Process for building upward in a residential neighborhood <br />The process to build upward in a residential neighborhood in Redwood City is fundamentally flawed. It does not <br />protect existing single story neighbor homes from losing their fundamental right to privacy, and natural law <br />right to the heat—energy source of the sunlight. <br />The requirements should be this for existing single story homeowners : <br />a) to protect the single story homeowners who wants to Build Upward from wasting money on architectural <br />designs, that homeowner should have to get immediate neighbor approval and submit that to the planning <br />department. If he gets the immediate neighbors approval that it will not affect a) their right to privacy, and <br />b) their right to sunlight on their properties, then the Planning Department would then give him a go ahead to <br />spend money on architectural design drawings. if he / she spends money before this to passify neighbors <br />requests to see documentation, it's clear that he did this of his own risk, and the planning department need <br />not spend any time on those architectural design drawing reviews. <br />b) To protect the existing neighbors single story family homes rights to privacy and natural law sunlight— <br />energy, the immediate neighbors would have to sign off on an I.N.A.F. = immediate neighbor approval <br />form. <br />c) I.N.A. = Immediate Neighbor Approval would be defined as: all 5 neighbors on the perimeter of the proposed <br />build upward property if that property is on an inner lot of a block. If it is a corner lot that would be the 3 <br />immediate neighbors that border that property. If it is any strange location that does notfit those 2 criteria, it <br />will be all perimeter neighbors that touch that property directly and at property corner edges. <br />I have contacted all of my single story neighbors on my 300-400 block of Topaz Street and they believe our <br />family should have the legal right to stop a 2' story build at 375 Topaz Street.
