To: The Redwood City Council Date: 07/23/2018 for 7:00 pm Meeting
From: Paul and Marie Nickels Subject: Fundamental Design Review Process Flaw
363 Topaz Street, Redwood City to build a 20 story addition in residential areas
Letter to Urge the City Council to task the RWC Planning Department
with ammendingthe Process for building upward in a residential neighborhood
The process to build upward in a residential neighborhood in Redwood City is fundamentally flawed. It does not
protect existing single story neighbor homes from losing their fundamental right to privacy, and natural law
right to the heat — energy source of the sunlight.
The requirements should be this for existing single story homeowners:
a) to protect the single story homeowners who wants to Build Upward from wasting money on architectural
designs, that homeowner should have to get immediate neighbor approval and submit that to the planning
department. If he gets the immediate neighbors approval that it will not affect a) their right to privacy, and
b) their right to sunlight on their properties, then the Planning Department would then give him a go ahead to
spend money on architectural design drawings. If he / she spends money before this to passify neighbors
requests to see documentation, it's clear that he did this of his own risk, and the planning department need
not spend any time on those architectural design drawing reviews.
b) To protect the existing neighbors single story family homes rights to privacy and natural law sunlight—
energy, the immediate neighbors would have to sign off on an I.NA.F. = immediate neighbor approval
form.
c) I.NA. = Immediate Neighbor Approval would be defined as: all 5 neighbors on the perimeter of the proposed
build upward property if that property is on an inner lot of a block. If it is a corner lot that would be the 3
immediate neighbors that border that property. if it is any strange location that does not fit those 2 criteria, it
will be all perimeter neighbors that touch that property directly and at property comer edges.
I have contacted my single story neighbors in close proximity while dog walking and they believe our family
should have the legal right to stop a 2nd story build at 375 Topaz Street. They believe we have a Fundamental
Right to Privacy and a Natural Law Right to Sunlight— Energy. I have requested they sign this letter in support
of the Nickels family effort to stop the 2nd story build at 375 Topaz Street.
Property Owners Signature
U;1Pc itrt
Property Owner's Address
5io ln6,ruo aT vLwc,C,' (tOw2
i3 a /"17JW ';- Abu' C "r4-GdZ
Sn-vPttleG si- FW r- GA. 9ybZ
