<br />6.2A <br />Page 2 <br /> <br />City representatives, Coastside presented their request for cost impacts for delays, and <br />stated that they will formally submit a claim to the City. <br /> <br />At this time, based on legal advice from the City Attorney's office, staff is recommending <br />acceptance of the completion of the project, returning the bonds, and releasing the <br />retention. Further legal action may be needed to settle the claim with Coastside <br />Associates. <br /> <br />In addition, based on the contract schedule and specifications, 25 days of liquidated <br />damages in the amount of $500/day for a total of $12,500 will be assessed against the <br />contractor and reduced from the retention amount. <br /> <br />Alternative <br />The only alternative would be to not accept the work and retain the contractor's bonds, <br />insurance, and retention which would be contrary to prior Council action. <br /> <br />Fiscal Impacts <br />Funds in the amount of $718,000 were budgeted for the Schaberg Library Renovation <br />Project from the Capital Improvement Program. There is a remaining balance of <br />approximately $60,000.
