<br /> <br />6.3A <br />Page 1 <br /> <br />February 13, 2006 <br /> <br />Subject <br />Highway 101 Bicycle Path - Recycled Water Transmission Line <br /> <br />Recommendation <br />By Resolution, approve Amendment No.1 to the Contribution Agreement between the City <br />of Redwood City and the State of California for Highway 101 Bicycle Path - Recycled <br />Water Transmission Line Cost Share <br /> <br />Background <br />On June 3, 2002, by resolution, the City Council approved the Contribution Agreement with <br />the State of California Department of Transportation (Caltrans), and authorized the City <br />Manager to enter into the Contribution Agreement ("Agreement") for the City to pay 1 00% <br />of the actual cost of the installation of a 24-inch recycled water transmission line in the <br />Highway 101 right-of-way. On the same date, the Council also approved the bike path <br />Maintenance Agreement with Caltrans, which commits the City to fund and provide on- <br />going maintenance services for the path. Staff is waiting for Caltrans to close out their <br />construction contracts and turn the path over to the City, anticipated in April 2006. <br /> <br />Caltrans is nearing completion of the Highway 101 auxiliary lane improvement project, <br />including construction of a new 12-foot wide bicycle path adjacent to Highway 101 between <br />the Whipple Avenue on-ramp and Sky Way frontage road in San Carlos. Caltrans has <br />performed the construction of the 24-inch recycled water transmission line under the bike <br />path. The pipeline is capped at both ends for future connection to the Redwood City <br />recycled water system. This segment of the transmission infrastructure will move large <br />volumes of recycled water from its source at the South Bay Systems Authority treatment <br />plant out of Redwood Shores into the rest of Redwood City. Consistent with input from the <br />City Council Utilities Committee to create maximum future flexibility / capacity, the pipe was <br />sized to serve Redwood City and other, adjacent agencies and/or users as well. <br /> <br />Subsequent to the approval of the Agreement, Caltrans informed city staff that two <br />provisions related to state statutes had been inadvertently omitted from the Caltrans <br />agreement form and that an amendment would be requested to incorporate those into the <br />Agreement. Staff agreed to process the amendment request, and also agreed to wait until <br />substantial completion of the pipeline and bike path construction, in case any additional <br />items came to light. To date, there have been no additional construction-related items <br />identified. The attached "Amendment to Contribution Agreement" describes two new <br />articles to be incorporated into the Agreement: <br />. Article 11 clarifies that the City is solely responsible for removing or relocating the <br />recycled water transmission line in the event that future State improvements to <br />Highway 101 require the pipe to be moved.
