<br />mitigated by the fact that the bike path occupies the outer limit of the existing State <br />right-ot-way, and the lands beyond are part otthe Don Edwards San Francisco Bay <br />National Wildlife Refuge. Additionally, the bike path was a permit requirement <br />imposed on Caltrans by the San Francisco Bay Conservation and Development <br />Commission, and it is considered as a segment of the San Francisco Bay Trail. It is <br />unlikely that Caltrans will ever be permitted to change or remove the bike path <br />portion of the Highway 101 right-of-way. <br />. Article 12 gives Caltrans rights to use Redwood City recycled water in the future, <br />and provides for reduced pricing of the water, as well as assurance that - if their <br />irrigation systems are connected to the system - their supply will not be reduced in <br />the tuture. By virtue of the Council's recently adopted policy for pricing recycled <br />water, the 20% discount to Caltrans falls within the 25% discount that City <br />customers will enjoy. Also, the City's terms and conditions on its customer <br />application forms provide similar assurances that - so long and the water.is being <br />used in compliance with safety regulations and City rules - the City is committed to <br />providing a reliable and continuous supply of recycled water for irrigation purposes. <br /> <br />6.3A <br />Page 2 <br /> <br />In addition, the language in Article 10 has been modified to reflect that Articles 11 and 12 <br />stay in effect unchanged after the Contribution Agreement terminates. <br /> <br />Staff recommends that the Council approve Amendment No.1 as requested by Caltrans. <br /> <br />Alternative <br />At this juncture, the Council may authorize the Agreement amendment or not, and provide <br />direction to staff accordingly. <br /> <br />Fiscal Impact <br />Amendment No.1 to the Contribution Agreement will not create a fiscal impact above and <br />beyond the City's previous commitments and obligations for the construction of the <br />recycled water transmission line under the bike path ($1.8 million). <br /> <br />Peter Ingram <br />Public Works Sa <br /> <br /> <br />(11 r# ~ F6~~ <br /> <br />Ed Everett <br />City Manager <br /> <br />Attachments <br />1.
