<br />lagoon bank. <br /> <br />7A <br />Page 7 <br /> <br />Cons: <br /> <br />-Exposes the City to increased liability should slope failure occur as a <br />result of existing non-permitted improvements. <br />-Limits the City in its ability to achieve desired water flow rates, which <br />could impact overall water quality. <br /> <br />Fiscal Impact <br />If slope failure were to occur as a result of illegal construction on the lagoon bank, the fiscal <br />impact to the City and affected property owners would be hugely significant. Given the <br />existing build-out of the Redwood Shores community it would be extremely difficult to get <br />the necessary machinery in to re-compact the lagoon bank. The possibility also exists that <br />the lagoon would need to be drained in order to do the necessary work. Any cost estimates <br />would need to reflect the degree of failure that occurred. <br /> <br />Requiring properties that have been identified with "Level 3" improvements to remove <br />and/or modify existing improvement would require a significant amount of staff time from a <br />code enforcement perspective; however, the property owners would bear the expense of <br />the removal and/or modification. <br /> <br />Conclusion <br />The City has yet to address the growing concern of non-permitted (illegal) improvements <br />on waterfront properties in the Redwood Shores community.
