<br />be entitled to the return of any funds contributed to the Narcotics Task <br />Force nor to the return in cash or in kind of any materials or supplies <br /> <br />(other than vehicles or communication equipment) until termination of this <br />agreement. If a party withdraws from this agreement, its employees shall <br /> <br />cease working for the Narcotics Task Force on the effective date of such a <br />party's withdrawal. If a party fails to make its contribution of either <br /> <br />personnel or money in accordance with Section 7 of this agreement, it will <br />be deemed to have withdrawn as of the end of the fiscal year in which it <br /> <br />last made its contribution. <br /> <br />4. <br /> <br />Section 20 of the joint powers agreement is hereby amended to read as follows: <br /> <br />20. <br /> <br />Insurance. The County shall continue to add the Narcotics Task <br /> <br />Force to its excess liability insurance coverage and shall maintain such <br />coverage in full force and effect during the life of this agreement. Said <br /> <br />excess liability insurance coverage has a self-insured retention by the <br /> <br />County. County shall provide for the defense of any claims or litigation <br />against the Narcotics Task Force or its permanently assigned personnel <br /> <br />within the self-insured retention. Permanently assignèd personnel are <br />those persons working under the supervision and direction of the <br /> <br />Commander. Legal representation for any such claims or litigation will <br /> <br />ordinarily be provided by the office of the County Counsel. <br />Any out-of-pocket expenses or loss by way of judgment or <br /> <br />settlement, arising out of the acts or omissions of the Narcotics Task Force <br /> <br />and its permanently assigned personnel within the limits of the County's <br /> <br />self-insured retention, shall be shared by the parties in accordance with the <br /> <br />following formula: <br />Fifty percent (50%) to be paid by the County and Fifty percent <br /> <br />(50%) to be paid by the Cities in accordance with the formula set forth in <br />
