<br />v. Officers, employees, agents or representatives of <br />the Agency and the City shall have the right of reasonable access <br />to the Property, without the payment of charges or fees, during <br />normal construction hours during the period of construction of the <br />Project for the purposes of this Agreement, including, but not <br />limited to, the inspection of the work being performed in <br />constructing the Project. Such officers, employees, agents or <br />representatives of the Agency and/or the City shall be those <br />persons who are so identified by the Executive Director. <br /> <br />w. The Developer shall provide the Agency with a <br />completion bond or completion guaranty, issued by an insurer <br />approved by the Agency in the reasonable exercise of its <br />discretion, which shall insure that the Project will be completed <br />if the Developer defaults in the terms of this Agreement regarding <br />completion of the Project in compliance with the Schedule of <br />Performance. The completion bond will be in an amount not less <br />than the amount estimated by the Developer for the complete <br />construction of the Project as set forth in pro forma budgets <br />prepared by the Developer and approved by the Agency. <br /> <br />x. The Developer acknowledges that federal funds will <br />be used in the development of the Project. The Developer agrees to <br />provide the Agency with such forms and/or reports as might be <br />required by the terms of the federal program from which such funds <br />are derived. If the Developer enters into any leases with any <br />tenants on the Property, the leases shall contain language <br />requiring the tenants to provide the Agency with such forms and/or <br />reports as might be required by the terms of the federal programs. <br /> <br />y. With regard to Federal Laws and regulations, the <br />Developer shall, unless otherwise exempted under Federal, State or <br />local law, comply with following as set forth in Subpart K, (Sec. <br />570.600-612), Code of Federal Regulations (September 6, 1988): <br /> <br />i. Public Law 88-352, Title VI of the Civil Rights <br />Act of 1964, which provides that no person in the United States <br />shall be excluded from participation in, be denied the benefits of, <br />or be subjected to discrimination under any program or activity <br />receiving Federal financial assistance, including community <br />development funds, on the grounds of race, color, or national <br />origin. <br /> <br />ii.
