<br />or practices of discrimination or segregation with reference to the
<br />selection, location, number, use or occupancy of tenants, lessees,
<br />subtenants, sublessee, or vendees in the premises herein conveyed.
<br />The foregoing covenants shall run with the land."

<br />b. In leases: "The Lessee herein covenants by and for
<br />itself, its successors and assigns, and all persons claiming under
<br />or through them, and this lease is made and accepted upon and
<br />subject to the following conditions: That there shall be no
<br />discrimination against or segregation of any person or group of
<br />persons, on account of race, color, creed, religion, sex, marital
<br />status, national origin, ancestry, sexual orientation or domestic
<br />arrangement in the leasing, subleasing, transferring, use,
<br />occupancy, tenure, or enjoyment of the premises herein leased nor
<br />shall the lessee itself, or any person claiming under or through
<br />it, establish or permit any such practice or practices of
<br />discrimination or segregation with reference to the selection,
<br />location, number, use, or occupancy, of tenants lessees, sublessee,
<br />subtenants, or vendees in the premises herein leased."

<br />c. In contracts: "There shall be no discrimination
<br />against or segregation of any person or group of persons on account
<br />of race, color, creed, religion, sex, marital status, national
<br />origin, ancestry, sexual orientation or domestic arrangement in the
<br />sale, lease, sublease, transfer, use, occupancy, tenure, or
<br />enjoyment of the premises herein conveyed or leased, nor shall the
<br />transferee or any person claiming under or through it, establish or
<br />permit any such practice or practices of discrimination or
<br />segregation with reference to the selection, location, number, use,
<br />or occupancy, of tenants, lessees, sublessees, subtenants, or
<br />vendees of the premises herein transferred." The foregoing
<br />provision shall be binding upon and shall obligate the contracting
<br />party or parties and any subcontracting party or parties, or other
<br />transferees under the instrument.

<br />Section 4.05. Affordability Covenants. The Declaration
<br />of Affordability Covenants which shall be recorded against the
<br />Property shall contain covenants which shall require forty-nine
<br />percent (49%) of the Project's units to be used for affordable
<br />housing for persons with extremely low to very low incomes, with
<br />the remainder of the units (i.e. the remaining 51% of the units) to
<br />be reserved for persons or families with incomes not to exceed
<br />ninety percent (90%) of the Area Median Income, plus one manager's
<br />unit affordable to persons with the income specified in Section
<br />4.01 of the Agreement. Following the date a Certificate of
<br />Completion is issued for the Project and continuing throughout the
<br />term of the Affordability Covenants, the Developer shall annually
<br />file with the Agency complete and accurate reporting forms for the
