<br />Agency's review demonstrating compliance with the Affordability <br />Covenants. Such forms shall be provided by the Agency. <br /> <br />Section 4.06. Nondiscrimination and Related Covenants <br />Required bv Federal Law. The Developer agrees that the covenants <br />set forth in this Section 4.06 shall bind it, for itself and its <br />successors and assigns, and all subsequent holders of any interest <br />in the Property. The federally required covenants set forth in <br />this Section 4.06 shall be covenants running with the land and <br />shall consist of the following: <br /> <br />a. <br /> <br />Section 504 of the Rehabilitation Act of 1973 <br /> <br />(1) Pursuant to Section 514 (Public Law 93-112), to the <br />extent not otherwise exempted by applicable law, the Developer <br />agrees that no otherwise qualified persons with disabilities shall, <br />solely by reason of a disability, be excluded from the <br />participation in, be denied benefits of, or be subjected to <br />discrimination in the performance of this contract or in the <br />selection of low income owners to purchase the dwelling to be built <br />on the Property. <br /> <br />(2) Compliance of Section 504 of the Rehabilitation Act <br />of 1973, as amended, requires that all benefits, aids and services <br />are made available to persons with disabilities on an equivalent <br />basis with those received by non-disabled persons. The Developer <br />shall agree to be in compliance with Section 504 requirements by <br />developing a plan for compliance to be submitted to the Section 504 <br />Coordinator as soon as possible but not later than by the close of <br />escrow for this acquisition. Certain units within the Project <br />shall be constructed to comply with Section 504 of the <br />Rehabilitation Act of 1973 as set forth in the Scope of <br />Development. <br /> <br />b. Affirmative Action. The Developer certifies that it <br />is in compliance with the Equal Employment Opportunity Requirements <br />of Executive Order No 11246, as amended by Executive Order No 1375, <br />Title VII of the Civil Rights Act of 1964, the California Fair <br />Employment Practices Act and any other federal or state laws <br />pertaining to equal employment opportunity, and that it will not <br />discriminate against any employee or applicant for employment or <br />opportunity to purchase the dwelling to be built on the "property." <br />on the basis of race, religion, color, national origin, ancestry, <br />sex, age, physical or mental disability, marital status, sexual <br />preference, or political affiliation in matters pertaining to <br />occupancy, hiring, training, upgrading, transfers, compensation or <br />termination. <br /> <br />35 <br /> <br />REDW\OO06\DOC\001-7 <br />3/29/05 3:15 /rove <br />
