<br />c. <br /> <br />Fair Emplovment Practices <br /> <br />(1) In the performance of this contract, the Developer <br />agrees to not discriminate against any employee or applicant for <br />employment because of race, religion, color, national origin, <br />ancestry, sex, age, physical or mental disability, marital status, <br />sexual preference, or political affiliation. The Developer agrees <br />to take affirmative action to ensure that applicants are employed, <br />and that employees are treated during employment, without regard to <br />their race, religion, color, national origin, ancestry, sex, age, <br />physical or mental disability, marital status, sexual preference, <br />or political affiliation. Such action shall include, but not be <br />limited to the following: employment, upgrading, demotion or <br />transfers; recruitment or recruitment advertising; layoff or <br />termination; rates of payor other forms of compensation; and <br />selection for training, including apprenticeship. The Developer <br />agrees to post in conspicuous places, available to employees and <br />applicants for employment, notices to be provided by the City of <br />Redwood City setting forth the provisions of this Fair Employment <br />Practices section. <br /> <br />(2) The Developer agrees to permit access to its records <br />of employment, employment advertisements, application forms, and <br />other pertinent data and records by the State Fair Employment <br />Practices Commission, or any other agency of the State of <br />California designated by the awarding authority, for the purposes <br />of investigation to ascertain compliance with the Fair Employment <br />Practices section of this contract. <br /> <br />d. Nondiscrimination Based on Disabilitv. The <br />Developer hereby agrees that it will comply with the provisions of <br />Section 504 of the Rehabilitation Act of 1973, to the extent not <br />otherwise exempt under applicable law, as amended, providing equal <br />access and reasonable accommodations in employment programs and <br />services to persons who are disabled. To that end, certain units <br />within the Project shall be constructed to comply with Section 504 <br />of the Rehabilitation Act of 1973 as set forth in the Scope of <br />Development. <br /> <br />e. Interest of Public Officials. No members, officers, <br />employees, or agents of the City of Redwood City, no member of the <br />City Council and no other public official who exercises any <br />function or responsibility with respect to this Agreement or <br />Developer's Program during his or his tenure, or for one year <br />thereafter, shall have any interest, direct or indirect, in this <br />contract or a related subcontract, or the proceeds thereof.
