6.1.J. - Page 1 <br />REPORT <br />To the Honorable Mayor and City Council <br />From the City Manager <br />August 27, 2018 <br />SUBJECT <br />Award of Contract—Alameda De Las Pulgas Sidewalk Improvement Project <br />RECOMMENDATION <br />By Motion: <br />1. Approve and authorize the City Manager to execute the contract documents for the <br />Alameda De Las Pulgas Sidewalk Improvement Project; reject the Non-responsive <br />Apparent Low Bid of $345,000.00 from Empire Engineering of San Francisco, <br />California; and award the standard form construction contract (Section 00520) to the <br />second lowest responsible bidder, RK Engineering of San Francisco, California, for <br />their Responsive and Responsible bid of $356,368.00; and, authorize the City <br />Manager to increase the contract amount, if necessary, up to 10% of the original contract <br />amount, not to exceed $392,004.80; and confirm determination that the project is exempt <br />and meets California Environmental Quality Act (CEQA) exemption criteria as set forth <br />in Section 15302 (Replacement or Reconstruction) of the CEQA Regulations. <br />2. Approve the associated Sidewalk Easements, and authorize the City Manager to <br />accept the Sidewalk Easements at 343, 353, 355, 357, 367, and 391 Alameda De <br />Las Pulgas, and execute the related Certificates of Acceptance <br />BACKGROUND <br />On July 28, 2014 the City Council approved and authorized the City Manager to enter <br />into an Improvement Agreement with Ricky Hung Ngo and Yung Le to cover the cost of <br />sidewalk improvements between Harding Ave and the Hetch Hetchy right-of-way on the <br />easterly side of Alameda De Las Pulgas. The sidewalk improvements are associated <br />with the development of 353 and 355 Alameda De Las Pulgas as this roadway lacked <br />curbs, gutters, and sidewalks and did not meet existing City standards. Per the <br />agreement, the property owners are obligated to pay the cost for their frontage <br />improvements and the cost of the right-of-way improvement design for the full length of <br />the project. <br />During the approval of the plans for the development of the properties, City staff <br />determined that dedications would be needed for the sidewalk improvements.
