Such other findings of conflict with written public policy or with the public <br />interest as the Planning Commission may determine. <br /> <br />The proposed map does not conflict with any written public policy or with <br />the public interest. <br />Section 6. Vesting Tentative Map TM2017-005: Pursuant to Government Code <br />Section 66473.5, the Planning Commission finds that the proposed subdivision, <br />together with the provisions for its design and improvement, is consistent with the <br />General Plan as described in the staff report. <br />Section 7. Condominium Permit CP2018-001: (Article XI of the Subdivision <br />Ordinance): The Planning Commission finds that: <br />Pursuant to Article XI of Chapter 30 of the Municipal Code (Subdivisions), the <br />Project also requires approval of a Condominium Permit. The Project site is comprised <br />of four parcels that would be merged into one for condominium purposes. Upon <br />approval of the Vesting Tentative Map, the Project site would consist of one parcel that <br />would be subdivided for condominium purposes. Section 30.130 states: <br />“While condominium and community apartment projects present benefits <br />in the nature of increased amenities, opportunities for dwelling ownership <br />and leisure time, the special nature of such projects creates conditions <br />that may result in neglect, deterioration and lack of maintenance, causing <br />negative impact upon the health, safety, welfare and economic prosperity <br />of the City and its citizens. Because of the unique nature of the problems <br />created by condominium and community apartment projects, it is the <br />express intent of the City to treat such projects differently from other types <br />of multifamily dwellings and to establish rules and standards thereof, <br />regulating the construction of, and conversion to, condominium projects <br />and community apartment projects in the City.” <br />The Planning Commission finds that the Project as proposed complies with the <br />requirements of Article XI of the Subdivision Ordinance. <br />Section 8. Conditions of Approval: The Architectural Permit, Planned <br />Development Permit, Vesting Tentative Map, and Condominium Permit are hereby <br />approved based on the Planning Commission’s consideration and reliance on the <br />CEQA Memorandum and in accordance with the plans, details and descriptions <br />contained therein, attached hereto and incorporated herein by reference, and subject to <br />the Conditions of Approval as provided in Exhibit A attached to this Resolution. <br />Section 9. This Resolution is effective upon its adoption.
