<br />otherwise provided for in this Franchise. A continuing pattern of repeated <br />noncompliance may be deemed a material breach of this Franchise, <br />provided that Grantee shall receive due process in accordance with Section <br />8.1 hereof, including prior written notification and a reasonable <br />opportunity to cure, prior to any sanction being imposed. <br /> <br />5. <br /> <br />Subscriber Contracts. Upon written request, Grantee shall supply City with any standard <br />form Subscriber contract utilized by Grantee. The length and terms of any Subscriber <br />contract(s) shall be available for public inspection during Normal Business Hours. A list <br />of Grantee's current Subscriber rates and charges for Cable Service shall be maintained <br />on file with City and shall be available for public inspection. <br /> <br />6. <br /> <br />Refund Policy. In the event a Subscriber establishes or terminates Service and receives <br />less than one (I) full month of Service, Grantee shall prorate the monthly rate on the <br />basis of the number of days in the period for which Service was rendered to the number <br />of days in the billing. Refund checks will be issued promptly, but no later than thirty (30) <br />days after the return of the equipment supplied by the Grantee if Cable Service is <br />terminated. <br /> <br />7. <br /> <br />Late Fees. Grantee shall abide by State of California requirements with respect to <br />assessment and collection oflate fees. Grantee acknowledges the City's right to adopt <br />further customer service requirements by ordinance in the event that the State of <br />California repeals current laws governing late fees to the extent permitted by Applicable <br />Law. <br /> <br />8. <br /> <br />Local Office. <br /> <br />a. <br /> <br />Grantee shall maintain a convenient location in San Mateo County pursuant to <br />Section 5.4, for receiving Subscriber inquiries, bill payments, and equipment <br />transfers. The location must be staffed by a Person capable of receiving inquiries <br />and bill payments and the location shall be open during Normal Business Hours. <br />In addition, Grantee shall maintain a drop box adjacent to Grantee's local office in <br />the City for receiving Subscriber payments after hours. <br /> <br />b. <br /> <br />Payments at Grantee's drop box location shall be deemed received on the date <br />such payments are picked up by Grantee which shall occur no less than twenty- <br />four (24) hours after each and every due date for Subscriber bills. <br /> <br />9. <br /> <br />Records and Reports. <br /> <br />a. <br /> <br />Grantee shall at all times maintain: <br /> <br />1. <br /> <br />A written or computer-stored record of all service calls and interruptions <br />or degradation of Service experienced for the preceding two (2) years, <br />provided that such complaints result in or require a service call, subject to <br />the Subscriber's right of privacy. <br /> <br />22 <br />
