<br />Vll1. <br /> <br />IX. <br /> <br />2. <br /> <br />Insurance. <br /> <br />2. <br /> <br />For failure to provide any capability for PEG access use of the <br />Cable System required in this Franchise: One Hundred Dollars <br />($100) per day. <br /> <br />3. <br /> <br />For violation of applicable customer service standards: One <br />Hundred Dollars ($100) per day. <br /> <br />4. <br /> <br />For failure to provide reports, maps and information as required <br />under this Franchise: Fifty Dollars ($50) per day. <br /> <br />5. <br /> <br />For failure to obtain all required permits for Grantee's work in the <br />Right-of- W ay or otherwise fail to comply with the construction <br />standards set forth in Section 3 of this Franchise: One Hundred <br />Dollars ($100) per day. <br /> <br />The collection of damages by the City shall in no respect affect the <br />Grantee's obligation to comply with all of the provisions of this Franchise <br />or Applicable Law. <br /> <br />In conformance with the procedural requirements herein, the City shall be <br />entitled to draw upon the Grantee's performance bond or any security to <br />collect the foregoing damages. <br /> <br />Grantee shall procure and maintain for the duration of the Franchise insurance <br />against claims for injuries to persons or damages to property which may arise <br />from or in connection with the operation of the Franchise by the Grantee, its <br />agents, representatives, employees or subcontractors. <br /> <br />a. <br /> <br />b. <br /> <br />Grantee shall maintain limits no less than: <br /> <br />1. <br /> <br />11. <br /> <br />111. <br /> <br />General Liability: Two Million Dollars ($2,000,000) per occurrence for <br />bodily personal injury and property damage. If Commercial General <br />Liability Insurance or other form with a general aggregate limit is used, <br />either the general aggregate limit shall apply separately to this Franchise <br />or the general aggregate limit shall be twice the required occurrence limit. <br /> <br />Automobile Liability: Two Million Dollars ($2,000,000) per accident for <br />bodily injury and property damage. <br /> <br />Workers' Compensation insurance as required by the State of California, <br />and Employer's Liability Insurance. <br /> <br />c. <br /> <br />Any deductibles or self-insured retentions must be declared to and approved by <br />City.
