<br />78 <br />Page 48 <br /> <br />state to state. Federal and applicable State laws will dictate the <br />definitions of straight time, overtime and double time. <br /> <br />2. Benefits <br /> <br />City agrees to reimburse Contractor its actual costs for the following <br />benefits provided to Contractor's personnel and as defined in both the <br />Contractor's Employee Manual and within the approved budget (Exhibit <br />"B") : <br /> <br />a. Health and Dental Insurance <br />b. Vacation/Sick/Holiday <br />c. 401 K Plan <br /> <br />3. Holidav Pay <br /> <br />Payments made by Contractor to its personnel for holiday pay shall be <br />reimbursed by City to Contractor in accordance with Contractor's written <br />policies, and as provided in the approved budget (Exhibit UB") as <br />provided to its employees as part of the new employee orientation <br />process. <br /> <br />4. Taxes <br /> <br />City shall reimburse Contractor for all actual employee payroll taxes and <br />insurance costs incurred for FICA, Federal Unemployment Insurance, and <br />State Unemployment Insurance for services provided pursuant to this <br />Agreement in accordance with the approved annual budget. <br /> <br />5. Workers' Compensation <br /> <br />Workers Compensation shall be paid per the Statutory requirements and <br />as identified in the budget (Exhibit "B"). <br /> <br />6. Maintenance Expenses <br /> <br />City agrees to reimburse Contractor for general services, and supplies, <br />purchased in accordance with this Agreement. <br /> <br />7. Telephone Expenses <br /> <br />City agrees to reimburse Contractor for actual telephone operating <br />expenses incurred in accordance with this Agreement, for telephone, on- <br />site management and supervisory personnel's cell phones, fax machine, <br />and computer modem services. Personal use of the said services by the <br />Contractor's employees shall not be tolerated, nor compensated by City to <br /> <br />18 <br />
