to provide hearing examiner services for the CITY and will perform all duties diligently and completely and in accordance with professional standards of conduct and performance. CONSULTANT will take all actions to timely fulfill the obligations of the CITY for the hearing officer established by all applicable local and state laws. CONSULTANT's scope of work expressly includes, but is not limited to, preparing for, administering, and conducting hearings in accordance with the Redwood City Code, creating an administrative record, examining all exhibits and evidence offered and making evidentiary rulings as necessary, and preparing a clear and comprehensive written decision. (Collectively this scope of work will be referred to hereinafter as "WORK.") 2. TERM. The term of this Agreement will be for a period of two years from the EFFECTIVE DATE, set forth above, or unless earlier terminated in accordance with the terms of this Agreement. 3. INCORPORATION OF RECITALS. The above recitals are hereby incorporated into this Amendment as if fully set forth herein. 4. CONSIDERATION. As full consideration for the WORK to be performed by CONSULTANT, CITY will pay CONSULTANT upon submission and CITY approval of invoices at the specified hourly rates and "not to exceed" amount. The hourly rate will be Two Hundred Dollars ($200.00) for preparatory time, conducting hearings, and written decisions. In no event will total costs under this Agreement exceed Fifty Thousand Dollars ($50,000) without written amendment to this Agreement. CONSULTANT may charge CITY for actual costs for extraordinary expenses such as courier services and express mail, but will not separately charge for travel, long-distance telephone calls, copying, postage, etc. These hourly rates and actual costs include all labor, material, and expenses provided and/or required under this Agreement. CONSULTANT will bill time monthly on a straight hourly basis.
