The City of San Mateo's ordinance <br />does not require that no -smoking signage be posted.62 <br />Enforcement and Compliance <br />Those jurisdictions with MUH smoking ordinances typically assign the responsibility for enforcement <br />of the ordinances to either their law enforcement or code enforcement personnel. Such enforcement <br />officers generally do not issue citations for first offense violations of MUH smoking ordinances. In <br />fact, it is difficult for them to issue citations at all because they must (1) observe the violation in <br />progress, (2) see other compelling evidence that a violation had occurred, or (3) have the alleged <br />violator admit to law or code enforcement that he or she had been smoking in violation of the MUH <br />smoking ordinance. 63 <br />Officers interviewed by the Grand Jury stated that most of the alleged MUH smokers they spoke with <br />in response to a complaint said they were unfamiliar with the smoking ordinance restrictions.
